Should the property transfer ownership prior to six months, <br /> the repairs shall be made prior to the sale of the property. Ernest Virgilio seconded. Motioned seconded by Kripani Patel. Roll Call <br /> Vote: Kripani Patel (yes), Ernest Virgilio (yes). VOTE: Unanimous (2-0) <br /> 6. Review of Mashpee Shell Tobacco Violation. On November 9, 2021, a compliance check <br /> was performed by the Cape Cod Regional Tobacco Control Program. The sale of a <br /> product that meets the definition of a blunt wrap was being sold at the Mashpee Shell <br /> establishment. The product that was sold was called Grabba Empire Leaf which is a <br /> loosely rolled leaf and not a hard cigar. The order letter has been provide to the board <br /> members. As this is the third violation within the 48 month tolling period, a fine of$300 <br /> is imposed along with a period of tobacco sales permit suspension. The board has the <br /> discretion to suspend the permit for up to 30 days. The board did previously issue a 30- <br /> day suspension to Alltown Mobil for a third offense. <br /> Mr. Harrington commented that the owner,Java Mansoor, hired a lawyer, Robert Mills <br /> to represent him and the store. Mr. Mills has requested a continuance until the next <br /> meeting so he can better prepare. <br /> Ernest Virgilio motioned to continue the review of the Shell Tobacco violation until the <br /> next meeting. Kripani Patel seconded. Roll Call Vote: Ernest Virgilio (yes), Kripani Patel <br /> (yes) VOTE: Unanimous (2-0) <br /> Ernest Virgilio motioned to adjourned the January 20, 2022 Board of Health Meeting at <br /> 7:07 PM.
