Several conversations did occur with the owner <br /> regarding the violation and there was an attempt at first to repair the plumbing but no <br /> work has been reported or documented since the order letter was sent. <br /> As it has been approximately 9 months since any attempt to facilitate compliance, the <br /> Board should issue fines in the amount of$100.00 per day. To calculate the fines,working <br /> days from Monday to Saturday and excluding holidays, 226 days of separate violations <br /> occurred or 22,60 a 0m As this has been going really for four years, I think fines are in <br /> order. Mr.Giancola has not done the work. There has been 226 days of non-compliance. <br /> 1 / ay= $22,600. The owner can appeal to a Superior Court to fight the fines. <br /> s. Patel asked if this was the same violation that the board had seen previously for Mr. <br /> Giancola. Mr. Harrington stated that no. That was a septic violations this is a housing <br /> violation. <br /> There being no further comments or discussion Kripani Patel motioned to implement <br /> fines toowner of 58 Buccaneer Way for non-compliance of order letter from June 29, <br /> 2021 to be paid within 10 days of forced decision. Failure to pay fines may result in more <br /> fines or court action. Discussion cc I ion Relative to BluntWraps <br /> In Mr. Harrington®s comments for this topic, he requested the board rescind the <br /> prohibition of blunt wraps as this part of the regulation as it was causing more confusion <br /> and time for the Board of Health staff that it is worth. In this case specifically® Bob <br /> Collett,tobacco inspector, misidentified the product on his inspection form. Mr. <br /> Harrington believed on that situation alone the inspection is suspect. In the whole <br /> scheme of things with marijuana being legalized,there will be rolling papers in many <br /> forms. Mr. Harrington commented that the concentration should be keeping <br /> the tobacco products out of underage individuals hands and not punish the of age public <br /> for buying a tobacco rolling paper. <br /> There being no further comments or discussion, Kripam Patel motioned to rescind the <br /> prohibition of blunt wraps as a part of the Town of Mashpee Tobacco regulation, Ernest <br /> Virgilio seconded.
