MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> FEBRUARY 22, 2023 <br /> The Board had a conversation and needed to know if there was a 2002 Decision from the Board. <br /> Attorney Kirrane there were only meeting minutes from August 2002, that the Zoning Board <br /> determined that the permit was still valid, but he could not locate the Decision. <br /> Mr. Ken Marsters an abutter spoke to the Board and said that the permit has lapsed. The 1980 <br /> Special Permit phasing project was for 10 years and extended in 1990, but phased out, and was <br /> invalid by the Cape Cod Commission. He provided a documentation timeline and the Cape Cod <br /> Commission. <br /> Mary Wagen, Ashumet Road approached the Board and said that the Planning Board made some <br /> minor changes to the 2002 Quashnet Valley subdivision plan, and approved the engineering to <br /> establish fire access of the entrance to the club house. <br /> Arden Russell approached the Board and is in opposition of the project. <br /> Mr. Morris approached the Board and told them that he had a discussion with Town Counsel <br /> stating that he agreed that the permit has lapsed. <br /> The Board had a discussion and agreed that the permit has lapsed, and asked for an explanation. <br /> Mr. Morris said under Condition 10. <br /> Attorney Kirrane said that he could apply for a Chapter 40B or a cluster subdivision. <br /> Mr. Bonvie made a motion that the Board grant the appeal of the Zoning Enforcement Officer's <br /> Decision in reference to the modification of the 1980 Special Permit Quashnet Valley <br /> Development which would allow the construction of twenty nine (29) single family homes on <br /> property located in and R-5 Zoning District, at 234 Old Barnstable Road, Map 59 Parcel 5, <br /> Mashpee, MA, to Owner, Anthony J. LaCava, Jr., Trustee. <br /> Mr. Blaisdell, seconded, no, Mr. Pittsley, voted no, Mr. Gould, no, Mr. Bonvie, no and upholding <br /> the Decision of the Building Commissioner's Decision, and Mr. Furbush, no. The Board voted to <br /> uphold the Building Commissioner's Decision. <br /> Sitting on this hear are the four regular Board members and Robert Caggiano. <br /> 31 Quaker Run Road: Petitioner, Otavio Oliveira Construction, Inc. requests a Special Permit <br /> under §174-17.1 of the Zoning Bylaws to raze and replace an existing non-conforming single <br /> family residential dwelling with a new single family residential dwelling on property located in an <br /> R-3 Zoning District, Map 83 Parcel 8-0, Mashpee, MA.
