MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> FEBRUARY 22, 2023 <br /> Mr. Netto, Building Contractor, and Brock Tucy, Excavation Contractor represented the <br /> homeowners for the raze and replace project. Mr. Netto mentioned that there was an issued <br /> building permit but after careful consideration and discussion with the homeowners made a <br /> decision to remove the existing building foundation and rebuild a code compliant home in the <br /> original footprint. <br /> Mr. Morris read a letter dated February 13, 2023 from Richard J. Hood, PLS. "I have been asked <br /> to write a letter stating that the proposed building at 31 Quaker Run Road will be built in the <br /> location shown on the plan. I have told the contactor that I will state the proposed locations <br /> following the demolition of the existing house, (When requested to do so). I also recommended <br /> that the proposed foundation corners be pinned on the new footing. (When requested to do so.). I <br /> hope these assurances will serve." <br /> Mr.Netto said that the proposed house will have the same number of bedrooms. The height of the <br /> building is 24.3 ft. <br /> Ms. Sangeleer read comments into the record from the Board of Health dated February 13, 2023: <br /> "Septic Designed for two bedroom approved 6-22-22. Health Department is ok." <br /> Ms. Sangeleer read a letter into the record dated February 21, 2023 from Catherine Laurent, DPW <br /> Director, "I spoke with a representative of the property owners at 31 Quaker Run. They are in <br /> agreement to construct a new driveway on their property along the northerly property line and <br /> understand that a Curb Cut Permit would be required from DPW.Because the hearing is tomorrow, <br /> we thought ZBA could just impose a condition since there won't be time to revise the plans." <br /> The Board reviewed the site plan and building plans. There are no new non-conformities being <br /> created, and the existing shed will be removed. <br /> There were no more comments from the Board, and no comments from the audience. <br /> Ron made a motion that the Board issue a Special Permit to Petitioner, Otavio Oliveira <br /> Construction, Inc. for 31 Quaker Run Road under §174-17.1 of the Zoning Bylaws to raze and <br /> replace an existing non-conforming single family residential dwelling with a new single family <br /> residential dwelling on property located in an R-3 Zoning District, Map 83 Parcel 8-0, Mashpee, <br /> MA. (Owners of Record: Arnold R. Henderson and Jeannette A. Gerald) with the following <br /> conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 12 <br />
