MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> FEBRUARY 22, 2023 <br /> Mr. Furbush asked for the height of the proposed structure. The height allowed in the Popponesset <br /> Overly is 30 ft. The structure will be at 28 ft. according to the architect. The copula does not count <br /> in height as it is not considered habitable space. Mr. Furbush noticed that the lot has a sloping <br /> contour. Mr. Furbush asked that dry wells be installed. The driveway will be gravel. <br /> The Board reviewed the requirements and noted that the new house will be two stories,and limited <br /> to three bedrooms. <br /> Ms. Sangeleer read the Board of Health comments into the record and the Conservation <br /> Department comments into the record. <br /> Ms. Sangeleer read a letter into the record from Chris and Mary Ann Coffee that are abutters to <br /> the property. They disapprove of the project and believe it is twice the size of the original structure. <br /> Mr. Morris said that the abutters discussed the project with him and were in the audience. They <br /> are concerned about the porch on the second level, and would like the house moved slightly back <br /> 7.9 ft. to 10 ft. which is still non-conforming and would be less obtrusive. <br /> Mr. Bonvie asked if the house could be made conforming by moving the house 3 ft. away. Mr. <br /> Kirrane said that if the house is moved forward, it would require a Variance. Mr. Bonvie said he <br /> is only one member. <br /> Ms. Eka said that there is a leaching field to consider. <br /> Mr. Coffee a direct abutter spoke and explained that he is not in favor of a two-story dwelling. <br /> Mr. Morris asked Mr. Coffee if he would agree to the proposal if the house can be moved 10 ft. <br /> Mr. Morris explained that the stairs are not a required egress. <br /> Mr. Bonvie reviewed the site plan with the abutter and applicant and suggested his possible ideas <br /> of the proposed dwelling. Mr. Bonvie asked Mr. Coffee if the building was brought to code if that <br /> would be acceptable. Mr. Coffee said; yes that would be preferable. <br /> There was no more discussion. <br /> Attorney Kirrane requested a continuance until March 8, 2023 to consult with his clients. Mr. <br /> Bonvie made a motion to accept the continuance. Mr. Gould seconded. A roll call vote was made, <br /> and all were in favor. <br /> 5 <br />
