MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 8, 2023 <br /> Mr. Coffey, 8 Cordwood Road, the direct abutter approached the Board. He said he has learned <br /> that if you own a non-conforming property, you shouldn't change it because if you do conform <br /> you will always have to conform. He thought that this meant "two wrongs make a right." He said <br /> at the last meeting, Mr. Bonvie's comments about razing and reconstructing a home would seem <br /> reasonable to adhere to the proper setbacks. He said his neighbors never had a conversation with <br /> him. Mr. Coffey told the Board he did have a conversation with the Building Commissioner, and <br /> reviewed the project. Mr. Coffey mentioned that the house across the street is the only house in <br /> the neighborhood that is larger than the other homes. <br /> Attorney Kirrane said he spoke with Mr. Coffey over the phone before the last hearing.Mr.Kirrane <br /> reiterated that they made a significant change to the plans. The existing dwelling is currently 3.8 <br /> ft. away from the property line, the foundation is now 13.6 ft. away. The bylaw would allow a two- <br /> foot cantilever encroachment of the 15 ft. setback. This project meets all the requirements of a raze <br /> and replace, and is not substantially more detrimental than the existing house. This house is fairly <br /> close to Wading Place Road, and he provided photos of homes that are fairly close to this <br /> neighborhood that are similar in size and character that the Board approved in the past. Mr.Kirrane <br /> said that this is a building code compliant structure, and there will be sufficient parking as required. <br /> This home is not within the wetlands resource area as the Conservation Commission confirmed. <br /> Mr. Morris told the Board that he did not tell Mr. Coffey that the applicants could do whatever <br /> they wanted. He spoke to Mr. Coffey in a professional manner. <br /> Mr. Furbush asked if this property was subject to LSTCSF. Attorney Kirrane said; no. This <br /> property is not within any wetlands resource areas as confirmed by the Conservation Commission. <br /> Mr. Furbush asked the Board if they had any more questions. <br /> Mr. Gould asked Attorney Kirrane if his client would agree to some screening of plants to help <br /> with the abutter's privacy concerns. <br /> Attorney Kirrane said if the Board were to condition such a request,he could ask his client if would <br /> agree to that request. Mr. Luff said there was several conversations with the client and Attorney <br /> Kirrane to redesign and make the appropriate changes that the Board had requested. Mr. Luff said <br /> that his client went above and beyond to accommodate the abutter's concerns. <br /> Mr. Furbush mentioned to Mr. Kirrane that the Board has approved several projects similar to this <br /> in the past, and since there is some push-back from the neighbor, suggested that some screening <br /> may help. <br /> Mr. Caggiano said to Mr. Coffey that the applicant has been very accommodating.
