Including but not <br /> limited to the Conservation Department, the Board of Health, and the Building <br /> Commissioner. <br /> 3. The Board finds that the proposed project under Section 174-17.1 is not substantially <br /> more detrimental than the pre-existing, non-conforming structure or use to the <br /> neighborhood. There is sufficient land area for parking; the project is not substantially <br /> more detrimental than what currently exists, and there are no new non-conformities being <br /> created. <br /> The Board finds that the proposed project under Section 174-17.1 is not substantially more <br /> detrimental than the pre-existing non-conforming structure to the neighborhood. There is <br /> adequate parking, and there are no new non-conformities being created. <br /> Mr. Gould seconded, yes <br /> Mr. Caggiano, yes, <br /> Mr. Reidy, yes, <br /> Mr. Bonvie, yes, <br /> Mr. Furbush, yes. <br /> All were in favor to issue a Special Permit. <br /> Sitting on this hearing are the four regular Board members and Associate, Brad Pittsley. <br /> 205 Uncle Percys Road: Petitioner, BSS Design, Inc. requests a Written Finding under §174-17 <br /> and §174-33 of the Zoning Bylaws to allow for an addition, alteration of an existing dwelling <br /> within the 50 ft. setback to wetlands on property located in an R3 Zoning District, (New Seabury), <br /> Map 123 Parcel 185, Mashpee, MA. (Owners of Record: Sanjeev and Sarika Aggarwal). <br /> (Continued from February 22, 2023 hearings). <br /> Mr. Thomas Bunker represented the applicants for the Written Finding request. This hearing was <br /> continued to allow the applicant to revise the lot coverage calculation on the site plan. The <br /> existing lot coverage was 10.94% which included the entire lot without subtracting the flood <br /> zone, and minus the flood area is 12.84%, and the proposed lot coverage will be 14.83%. Mr. <br /> Bunker received a letter from FEMA and gave a copy to the Building Commissioner. <br /> Mr. Bonvie confirmed that the wetlands calculations was revised on February 28, 2023. <br /> Mr. Reidy read the Board of Health comments dated March 6, 2023 into the record. <br /> Mr. Furbush read the Conservation Department comments dated March 6, 2023 into the record. <br /> There were no more comments from the Board or audience. <br /> 5 <br />
