Town of Mashpee
BOARD OF HEALTH
16 GREAT NECK ROAD NORTH
MASHPEE, MASSACHUSETTS 02649
(508) 539-1426 * Fax (508) 477-0496

BOARD OF HEALTH – PUBLIC SESSION
Mashpee Town Hall – Waquoit Meeting Room

th
Minutes of the Meeting of April 4, 2023

Board Members Present: Members Absent: Also Present:
Ernest Virgilio, Chair Zackary Seabury, Health Agent
John Livingston, Vice-Chair
Ed Raposa, Clerk

Quorum of 3 Members Present

Ernest Virgilio, Chair, called the meeting to order at 4:30 pm.

PUBLIC HEARING – Proposed Revision to the Mashpee Board of Health Innovative Alternative On-Site
Septic System Regulation

\[Somewhat a continuation of discussion from 3/21/2023. However, today was the vote to approve or
deny the amendment.\]

Mr. Seabury, Health Agent, explained that this was a proposal for within 300’ distance from wetland for
I/A system requirement from a coastal area (nitrogen removal). Mr. Seabury assured the board this was
not going to be an aggressive policy (“Not going after people”). It was mainly for increases or new
construction. There would also be a decision mechanism on a case-by-case basis to provide flexibility.
Mr. Seabury went on to note the town sewer hookup taking place and the goal is to ease the town into it.
Mr. Seabury explained to the Chair no other town committees have taken up the issue, but they are aware
of the issue. Also, Mr. Seabury noted that this is an amendment not requiring the input of town counsel.
Mr. Livingston noted the presence of hardship down the road, but there is a need to do something, and
the Board needed to do its part.

Public Comment

Mary Waygan (35 Acushumet Road), speaking in her capacity as resident, commended the Board taking
up the issue. She noted that nitrogen has an undeniable effect on coastal ecosystems. In response to her
question about phosphorus, Mr. Seabury noted there were no systems yet approved or numbers.
After closing public comment, John Livingston made a motion to approve the amendment which was
seconded by Ed Raposa.
Roll Call Vote: John Livingston (Yes) Ed Raposa (Yes) Ernie Virgilio (Yes)
3-0 unanimous.

The amendment is attached.
