MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> March 22,2023 <br /> Mr. Rivera mentioned the proposed garage will be roughly in the vicinity of the existing shed. It <br /> is outside of the 100 ft. buffer zone to the wetlands. An order of conditions was issued by the <br /> Conservation Commission and approved. A two car garage will be constructed and there will be <br /> some reconfiguration done to the driveway to have better access. The property is fairly flat so there <br /> is no changes made. The driveway will remain with crushed stone and is impervious. The garage <br /> roof run off will have down spots, and a shallow trench will be installed underneath the driveway <br /> because of the high groundwater table. The garage will be constructed with flood vents. <br /> Attorney Guard said that the Board needs to determine if the pre-existing shed structure being <br /> moved 0.7 ft.from the side line is more detrimental than the proposed garage that will be 5 ft. from <br /> the side line. The Board also has to determine if the lot coverage increasing from 11.5%to 14.9% <br /> is substantially more detrimental to the neighborhood. <br /> Chairman Furbush asked how many bedrooms are allowed on this lot. Mr. Rivera said that the <br /> septic system allows for five bedrooms. The property currently has four bedrooms and there will <br /> be a loft above the garage, and will remain at five bedrooms. <br /> The Board had a conversation regarding the comments submitted by the Board of Health <br /> read into the record; "BOH.- As long as no plumbing is added to the garage, BOH has no <br /> comment. Protective sleeve of septic line is approved. <br /> Attorney Guard said that he will be requesting a continuance to secure the architectural plans for <br /> the Board, and will have a conversation with the Board of Health regarding the garage. <br /> Mr. Bonvie asked how much of this lot is in the flood plain. Mr. Rivera said; the entire lot. The lot <br /> coverage is 100%. Mr. Bonvie requested that the site plan be revised as follows: lot structure <br /> coverage— 11.5%, and proposed lot structure coverage — 14.8%. Mr. Bonvie asked the applicant <br /> if he is creating any more new non-conformities. Attorney Guard; said no. The side yard is being <br /> reduced. Mr. Bonvie asked if the new structure will have flood vents. <br /> Mr. Rivera said yes,the flood vents have to be within a foot of the grade. <br /> Mr. Goldstein asked if the 1,723 sq. ft. represented the house and deck. Mr. Rivera said it also <br /> includes the shed. Mr. Goldstein also asked if the garage could be moved further toward the other <br /> side setback depicting the 21 ft. <br /> Mr. Rivera said that the setback from the wetlands is zero because of LSTCSF. Mr. Rivera said <br /> that there's approximately 12 ft. in order to gain access to the back of the house. <br /> Attorney Guard said that there will be preserved vegetation in that area. <br /> Ms. Sangeleer read the Conservation Department comments into the record that it was approved <br /> at their meeting. <br /> 4 <br />
