MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> APRIL 12,2023 <br /> The Building Commissioner does not have any issues. Mr. Goldstein does not have any issues if <br /> the Board of Health is satisfied. <br /> Attorney Kirrane said there are no Conservation issues. The two existing non-conformities of the <br /> front and rear are being eliminated and will become a conforming house in front, in the back and <br /> to both side setbacks. There are drywells being installed on the property to capture any roof runoff. <br /> There are no new non-conformities being created. There will be paved parking in the front to <br /> provide sufficient parking. The new building will be code compliant, and is consistent with other <br /> structures in the neighborhood. The front elevation complies with the height requirement under <br /> the 35 ft. There will be a new Title 5 septic system installed. Attorney Kirrane suggested to the <br /> Board that the new structure will not be substantially more detrimental to the neighborhood than <br /> what currently exists by eliminating the front and side non-conformities. <br /> Mr. Bonvie mentioned that the past two raze and replace projects will have Title 5 septic systems <br /> installed, and was curious why it wasn't a denite/innovative type system. He understands it is not <br /> under the Board's purview but wanted to understand the reason for past projects. <br /> Mr. Dibb said that his firm refers to the date that the plan was created, and may recommend that <br /> an innovative system be installed. <br /> Attorney Kirrane mentioned that it may be that this particular lot is not in a flood zone. <br /> Ms. Sangeleer read the comment from Attorney Kirrane that the height of the new home from the <br /> average grade at 28.9 %2 ft. <br /> There were no more comments from the Board. <br /> Mr. and Mrs. Sockbeson that reside at 294 Shore Drive are direct abutters to the subject property <br /> and had several questions on the project. Mr. Sockbeson mentioned that on the corner of Shore <br /> Drive and Pine Avenue is a historic area for flooding during rain events. Mr. Sockbeson wanted <br /> to review the actual height of the proposed house. He noticed on the plan that the mechanical units <br /> will be situated on his side of the house, and asked the Board if extra screening would help <br /> eliminate the noise. Mr. Sockbeson asked if generators will be running during construction. He <br /> asked if the line of trees along the property line belong to his lot or the subject property.. <br /> Mr. Bonvie mentioned that there is large impervious patio being proposed, and asked Mr. Dibb, <br /> Engineer if an additional dry well would be helpful and capture any water runoff. <br /> The Board asked Mr. Dibb if he could provide either a fence,wall or shrubbery to lessen the noise <br /> emitting from the mechanical units. Mr. Goldstein said that plantings are better absorbing sound, <br /> a fence or wall will just deflect the noise. The abutters agreed to shrubbery on three sides. <br /> Mr. Goldstein said that some builders will have a temporary service installed, but this is not part <br /> of the Zoning Board purview. <br /> 9 <br />
