MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> APRIL 12,2023 <br /> Mr.Bonvie made a motion that the Board accept Attorney Kirrane's request to continue the hearing <br /> for 90 Popponesset Island Road until Wednesday, May 24, 2023. Mr. Goldstein seconded, yes, <br /> Mr. Pittsley, yes, Mr. Bonvie, yes, Mr. Blaisdell, yes, and Mr. Furbush yes. <br /> 25 Menemsha Road: Owners, Paul J. and Kathryn M. Thurston request a Written Finding under <br /> §174-17 and §174-33 of the Zoning Bylaws to allow for construction of an in-ground pool and <br /> patio on property located in an R-3 and Popponesset Overlay District(s), Map 123 Parcel 10, <br /> Mashpee, MA. <br /> Ms. Sangeleer read a letter dated April 7, 2023 regarding 25 Menemsha Road from Attorney <br /> Christopher Kirrane requesting a continuance until Wednesday, April 26, 2023. <br /> Attorney Kirrane commented that this project is still being reviewed by the Conservation <br /> Commission. He believes the Commission has closed the hearing and will be deliberating on their <br /> April 20, 2023 hearings. If the Conservation Commission approves the project, it can be heard at <br /> the ZBA hearing on April 26, 2023. <br /> There were no comments from the Board or audience. <br /> Mr. Bonvie made a motion that the Board accept Attorney Christopher Kirrane's request of an <br /> extension for 25 Menemsha Road dated April 7,2023, and up until his request of April 26, 2023. <br /> Mr. Ganzenmuller, seconded, yes, Mr. Goldstein, yes, Mr. Bonvie, yes, Mr. Blaisdell, yes, and <br /> Mr. Furbush, yes. All were in favor. <br /> Sitting on this hearing are the three regular Board members,Associate Members,Robert Caggiano, <br /> and Sharon Sangeleer. <br /> 18 Str#MJbers1, Lane: Owners, William P. and Judith S. Ludwig request a Special Permit under <br /> §174-17.1; §174-17; of the Zoning Bylaws and M.G.L. c. 40A Section 6 to raze a pre-existing, <br /> non-conforming single-family dwelling and replace it with a new single- family dwelling on <br /> property located in an R-3 Zoning District, Map 112 Parcel 101, Mashpee, MA. <br /> Attorney Christopher Kirrane represented the applicants for 18 Strawberry Lane.Also present was <br /> K. Marshall Works, and the homeowners were present in the audience. Attorney Kirrane <br /> mentioned that this property is not in a flood zone, so there are no coastal issues with this project. <br /> The property is located in the R-3 Zoning District. Attorney Kirrane mentioned that every other <br /> property on this street is located within the Popponesset Overlay District except for this property. <br /> This lot is situated on the front of both Strawberry Lane and Spoondrift Way and needs to meet <br /> the 40 ft. setback on both streets. This lot is 12,885 sq. ft. and is non-conforming because it does <br /> not meet the 40,000 sq. ft. requirement. Additionally, this existing structure does not meet any of <br /> the minimal dimensional requirements. The lot does not meet the front yard setback to Strawberry <br /> Lane, at 23.2 ft., it does not meet the front yard setback to Spoondrift at 24.9 ft. <br /> 5 <br />
