a Town of Mashpee <br /> 16 Great Neck.Road North <br /> Mashpee, MA 02649 <br /> b, <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2023-07 <br /> Owner, Suzanne Rogers Bk.: 26995 <br /> 5 Mercantile Way Pg.: 318 <br /> (Map 88 Parcel 106) <br /> Mashpee,MA 02649 <br /> A Petition was filed on December 27,2022 by Owner,Suzanne Rogers requesting a Special Permit <br /> under §§174-3 7, 174-41 (M), 174-25 (G) (14), 174-45.6 (D), and §174-25 (G) (6) of the Zoning <br /> Bylaws to allow for construction of a 7,440 sq. ft. building for its lawn care and pest control <br /> business, and for storage of vehicles on property located in an I-1 and Light Industrial Overlay <br /> District(s), 5 Mercantile Way, Map 88 Parcel 106, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on January 6,2023 and January 13, 2023 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, January 25, <br /> 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, <br /> Ron Bonvie, and Associate Members, George Ganzenmuller and Brad Pittsley. <br /> Attorney Christopher Kirrane represented the prospective buyers of 5 Mercantile Way. A letter of <br /> authorization from the owner of the property was submitted to allow the applicant to proceed with <br /> the application for a Special Permit. Also present was Dan Ojala, Down Cape Engineering,Roger <br /> Brooks and Joao Junqueira with Capewide Construction. Mr. Ed Pesce, Consulting Engineer <br /> represented the Zoning Board of Appeals. <br /> The lot consists of 44,517 sq. ft. and is situated on a corner of both Mercantile and Commercial <br /> Streets. The proposed building consists of a 7,440 sq. ft. Morton style metal building,with five(5) <br /> separate contractor bays. The applicants proposes to occupy the two larger bays for their pest <br /> control and lawn business. Their vehicles will be parked onsite and will not be stored inside the <br /> contractor bays. The building itself meets all dimensional setback requirements and lot coverage <br /> as required under the bylaw. <br /> 1 <br />
