MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner, Suzanne Rogers <br /> 5 Mercantile Way (Map 88 Parcel 106) <br /> Mashpee, MA 02649 <br /> SP-2023-07 <br /> The applicants are requesting relief under§174-37 to allow for parking in front of the building due <br /> to the odd shape of the lot. The bylaw requires that there be 14 parking spaces on the side and rear <br /> of the building. The proposal includes 17 parking spaces and one handicap parking space. The <br /> proposed uses are similar to what the Board has allowed in the Industrial Zone and Light Industrial <br /> Overlay Districts, and will not result in any adverse impacts on public health and safety concerns <br /> as referenced under the bylaws. <br /> The project was before Design Review and Plan Review Committees for approval by the Zoning <br /> Board with the following recommendations: <br /> 1. The proposed drainage retention basin within the grading and drainage easement <br /> along Commercial Street, at contour 46 and 47, be evaluated appropriately by a <br /> qualified consulting engineer to ensure no detrimental impacts to the public roadway's <br /> storm water facilities. <br /> 2. The dumpster enclosure to be evaluated and modified if necessary to accommodate <br /> recycling in addition to trash collection and disposal. <br /> 3. The applicant will provide to the Fire Chief a list of chemicals and their quantities to <br /> be stored for any/all businesses in the contractor bays. <br /> 4. For remaining construction inspections outside of the review of the grading and <br /> drainage easement area adjacent to the proposed driveway entrance Plan Review <br /> recommends inspections be conducted by the design engineer, Mr. Ojala, with <br /> stamped written reports provided to the Board of Appeals for its files certifying that <br /> construction was completed in accordance with the approved plans. <br /> 5. No outside storage of materials unless otherwise approved by the Board of Appeals <br /> with a modification to any special permit that may be issued. <br /> Mr. Pesce provided the Board a detailed written letter dated January 23, 2023 of the site and <br /> engineered plans. Mr. Pesce had discussions with Mr. Ojala, Down Cape Engineering and <br /> addressed the details of the project, and the concerns submitted by Catherine Laurent, DPW <br /> Director. <br /> 2 <br />
