MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner, Suzanne Rogers <br /> 5 Mercantile Way (Map 88 Parcel 106) <br /> Mashpee, MA 02649 <br /> SP-2023-07 <br /> The Board read the comments submitted by Catherine Laurent,DPW Director dated January 25, <br /> 2023 into the record;"I am in agreement with Ed's report with one correction. Commercial Street <br /> is the only Town-owned road so DPW will only assume maintenance of the drainage structures <br /> in the southwest corner of the drainage easement on the property (overflow for the catch basins <br /> on Commercial Street). Industrial Drive and Mercantile Way are both private roads so the <br /> association or businesses on those roads are responsible for maintenance of their associated <br /> drainage." <br /> Mr. Ojala with Down Cape Engineering and Mr. Pesce reviewed the latest site plan and agreed <br /> that the slight enlargement of the retention area will manage and correct any drainage issues off of <br /> Commercial Street. Mr. Pesce reviewed the minor concerns as submitted to the Board and he <br /> recommended approval contingent upon receiving the final plans and erosion control plan. There <br /> will also be compliance inspections during construction and after construction with an as-built <br /> plan. Mr. Pesce will prepare a letter that the inspection was done for the drainage, and the Board <br /> of Health will be inspecting the septic system. The Water Dept. will review the water supply. <br /> The Board discussed the cost that should be placed in an escrow account for the peer review <br /> services. Mr. Pesce recommended that the applicant establish a $3,500 fee for an escrow account <br /> for inspections and close out of the project at or before obtaining a building permit. He would also <br /> have to write a letter prior to the certificate of occupancy being issued. Mr. Pesce submitted an <br /> invoice for his initial review of the site for $2,301.45. The total escrow amount would be <br /> $5,801.45. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Special Permit. <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday, January 25, 2023 <br /> the Zoning Board of Appeals voted unanimously to issue a Special Permit to Owner, Suzanne <br /> Rogers for 5 Mercantile Way under §§174-37, 174-41 (M), 174-25 (G) (14), 174-45.6 (D), and <br /> §174-25 (G) (6) of the Zoning Bylaws to allow for construction of a 7,440 sq. ft. building for its <br /> lawn care and pest control business, and for storage of vehicles on property located in an I-1 and <br /> Light Industrial Overlay District(s), Map 88 Parcel 106, Mashpee, MA with the following <br /> conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Site Plan—Prepared for Keith& Candace McKeone, Date: December 19, 2022, Scale: 1" <br /> = 20', Sheet 1 of 2, Prepared by: Down Cape Engineering, Inc. Stamped and signed by: <br /> Dan Ojala, Professional Engineering No.: 46502. Said site plan will be further revised with <br /> the final peer review comments and date as requested by Mr. Ed Pesce,Pesce Engineering, <br /> and also include an erosion control plan. <br /> 3 <br />
