Town of Mashpee <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2023-09 <br /> Owners, Sanjeev Aggarwal and Doc.: 1424410 <br /> Sarika Aggarwal Ctf.: 225779 <br /> 205 Uncle Percy's Road <br /> Map 123 Parcel 185 <br /> Mashpee,MA 02649 <br /> A Petition was filed on January 20, 2023 by Petitioner, BSS Design, Inc. requesting a Written <br /> Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for an addition, alteration of <br /> an existing dwelling within the 50 ft. setback to wetlands on property located in an R3 Zoning <br /> District, (New Seabury), at 205 Uncle Percy's Road,Map 123 Parcel 185, Mashpee,MA(Owners <br /> of Record: Sanjeev Aggarwal and Sarika Aggarwal). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on January 27, 2023 and February 3, 2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,February 22, <br /> 2023,and was continued until March 22, 2023 at which time the following members of the Board <br /> of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice Chairman, <br /> William Blaisdell, Board Members, Ron Bonvie,Norman J. Gould, and Associate Member, Brad <br /> Pittsley. <br /> Mr. Thomas Bunker,with BSS Design represented the homeowners who are proposing to add two <br /> small additions to an existing dwelling. The first addition will be located in the middle of the house <br /> and is labeled"Addition I"on the site plan, and the second addition will be on the left(west) side <br /> of the existing house"Addition 2" on the site plan. <br /> This property conforms to all setbacks and the lot coverage will be less than 20%. The existing <br /> house is 37 ft. from the wetlands and is non-conforming to the requirement under Section 174-33. <br /> Addition #1 is 50 ft. from wetlands, but 27 ft. from the coastal bank which is further from the <br /> wetland resource areas than the existing house. Addition#2, is further from the wetlands at 41 ft. <br /> 1 <br />
