MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Sanjeev Aggarwal and Sarika Aggarwal <br /> 205 Uncle Percy's Road (Map 123 Parcel 185) <br /> Mashpee, MA 02649 <br /> FINDING-2023-09 <br /> Mr. Bunker provided the architectural plans depicting the two additions. The first addition is a <br /> single-story addition located between the house and garage,and will not expand beyond the height <br /> elevations of the existing two-story home. The second addition is connected to the rear of the two- <br /> story house and will not change the character of the neighborhood. <br /> At the last meeting,the Board requested a revised site plan of the lot coverage calculations. The <br /> existing lot coverage was 10.94% which included the entire lot without subtracting the flood <br /> zone,minus the flood area is 12.84%, and the proposed lot coverage will be 14.83%.Mr. Bunker <br /> received a letter from FEMA and gave a copy to the Building Commissioner. <br /> The Conservation Department comments dated February 6, 2023 were read into the record; <br /> "Commission approved this project with condition of mitigation plantings and removal of existing <br /> platform deck near edge of pond. This platform deck is actually not on the applicant's property but <br /> rather on New Seabury Properties open space land." <br /> The Board of Health comments dated February 13, 2023 into the record. "Health Department is <br /> ok with the addition of a dining room(not to be used as a sleeping room) and the expansion of the <br /> Kitchen. There will be no increase in bedrooms. The existing septic permit states that a 5-bedroom <br /> septic is provided. The property is in Zone II so the dwelling is restricted to 5 bedrooms." <br /> GENERAL CRITERIA <br /> The subject property located at 205 Uncle Percy's Road is approximately 41,282 square feet. <br /> There were no abutters present. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued, although not conforming with the provisions of this chapter.Non-conforming single- <br /> or two-family dwelling structures may be changed, extended or altered if such change, extension <br /> or alteration complies with the dimensional requirements applicable to the lot under current <br /> provisions of§174-31 or,for lots which have been developed pursuant to§174-21,complies with <br /> such requirements as were applicable to initial construction of the dwelling under provisions of <br /> §174-21. <br /> 2 <br />
