<br /> In view of the foregoing,the Board determined the Petitioner met the criteria for a Special Permit
<br /> Modification.Upon motion duly made and seconded at the Public Hearings on Wednesday,April
<br /> 12,2023 the Zoning Board of Appeals voted unanimously to issue a Special Permit Modification
<br /> to Owner,Mashpee 151 Properties,LLC referencing(SP-97-73)under§174-24(C)(9)and §174-
<br /> 17 of the Zoning Bylaws to allow for construction of a 1,800 sq. ft. addition to the rear of the
<br /> existing retail building on property located at 425 Nathan Ellis Highway,in an R3 and C2 Zoning
<br /> District(s), Map 72 Parcel 56, Mashpee, MA with the following conditions:
<br /> 1. The Board has determined that the applicant meets all the conditions of a Modification to
<br /> a Special Permit under Mass General Law 40A Section 9.

<br /> 2023,as well as all Mr. Pesce's additional comments submitted,including but not limited
<br /> to the Fire Chief comments read into the record.
<br /> 6. Prior to the request of a building permit,the applicant shall issue a working capital account
<br /> in the amount of$5,000. The check shall be issued to the Town of Mashpee to be utilized
<br /> to pay for the initial peer review, and for future peer review inspections and signoffs.
<br /> 7. The applicant agreed to install ten(10)arborvitaes on Ms.Joanne Peters'property located
<br /> at 54 Sassacus Road, Mashpee,MA.
<br /> 8. Subject to the applicant shall submit a report of any ongoing review of the O&M drainage
<br /> plans and any tasks outlined in that report to be promptly submitted to the Zoning
<br /> Enforcement Officer, and if not done properly will be considered a violation of the
<br /> Special Permit Modification.
