MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner of record: Kevin P. Andrade, Trustee of Summerfield Park Realty Trust <br /> Petitioner, CatDogg LLC, d/b/a Sublime Cannabis <br /> 800 Falmouth Road, Units 102A and B I A, Map 88 Parcel 2 <br /> Mashpee, MA 02649 <br /> SP-2023-16 <br /> The Applicants addressed the concerns in detail regarding the parking situation at the location.The <br /> existing building is 12,000 square feet of commercial space. There will only be one point of entry <br /> and egress for customer flow of the proposed units.The CCC requires secured entry and customers <br /> are required to provide their age and identification information. There is currently 9,000 sq. ft. of <br /> space being occupied for manufacturing and retail. Building A will require 30 spaces, but the <br /> proposed business will only require 19. Forty nine (49) spaces would be required for the entire <br /> building, including the proposed business. The entire back row along the back side of the building <br /> totals 15 spaces and covers every tenant on the upper floor. The 2015 Planning Board Decision <br /> required 152 spaces, but the plan provides 167 for the denoted uses on the plan. <br /> Mr. Morris said that the building itself is being upgraded with fire resistant construction, and high <br /> end security will be largely increased. He has no issues as this is an allowed conforming use in the <br /> Industrial Zone, and in his experience there have been no issues with the parking. <br /> Mr.Furbush read aloud the Special Permit requirements under Section 174-24(C)(2)for the Board <br /> to consider. <br /> Mr. Furbush read the Plan Review Committee comments dated March 7, 2023 into the record. <br /> A motion was made by the Plan Review Committee recommending the following: <br /> • Board of Health requirements for a three(3) bay sink, and Title 5 Inspection. <br /> • Fire Department requirements; cut sheets, floor plans,review fire alarm panel <br /> and sprinkler system. <br /> • DPW Director Comments as detailed in an email dated March 7, 2023. <br /> SPECIAL PERMIT FINDINGS <br /> The Board heard final remarks and made the following findings; <br /> • The proposed application and use will be consistent with State and Town <br /> regulations, statues, bylaws and plans. <br /> • The proposed application and use will not adversely affect public health or safety, <br /> will not cause excessive demand on community facilities, will not significantly <br /> decrease surface or ground water quality or air quality, traffic flow, traffic safety, <br /> waterways public lands or neighboring properties. <br /> • The proposed application and use will provide adequate parking. <br /> 3 <br />
