MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> JANUARY 25,2023 <br /> 5 Mereaggle Way: Owner, Suzanne Rogers requests a Special Permit under §§174-37, 174-41 <br /> (M), 174-25 (G) (14), 174-45.6 (D), and §174-25 (G) (6) of the Zoning Bylaws to allow for <br /> construction of a 7,440 sq. ft. building for its lawn care and pest control business, and for storage <br /> of vehicles on property located in an I-I and Light Industrial Overlay District(s), Map 88 Parcel <br /> 106, Mashpee, MA. <br /> Attorney Christopher Kirrane represented the prospective buyers of 5 Mercantile Way. A letter of <br /> authorization from the owner of the property was submitted to allow the applicant to proceed with <br /> this application. Also present was Dan QjaIa, Down Cape Engineering, Roger Brooks and Joao <br /> Junqueira with Capewide Construction.Mr.Ed Pesce,Consulting Engineer called into the meeting <br /> on the conference room phone line, and is representing the ZBA. <br /> The lot consists of 44,517 sq. ft. and is situated on a comer of both Mercantile and Commercial <br /> Streets. The proposed building consists of a 7,440 sq. ft. Morton style metal building,with five (5) <br /> separate contractor bays, two of which are larger and will be occupied by the applicants for their <br /> pest control and lawn business. There will be business vehicles onsite but will not be stored inside <br /> the contractor bays. The building itself meets all dimensional setback requirements, and lot <br /> coverage as required under the bylaw. <br /> The applicant is requesting relief from under §174-3 7 to allow parking in the front of the building. <br /> The bylaw requires that there be 14 parking spaces on the side and rear of the building. The <br /> applicant is proposing 17 parking spaces and one handicap parking space. The proposed uses are <br /> similar to what the Board has allowed in the Industrial Zone and Light Industrial Overlay Districts, <br /> and will not result in any adverse impacts on public health and safety concerns referenced in the <br /> bylaws. <br /> The prQject was before the Design and Plan Review Committees and recommended that the Zoning <br /> Board provide a peer review from a consulting engineer at their meeting. The Zoning Board <br /> contacted Pesce Engineering to assist the Town. <br /> Mr. Ojala mentioned he spoke with Mr. Pesce to revise the site plan and discussed the issues with <br /> the Board. lie mentioned there was a concern regarding the drainage structures on the southwest <br /> comer. There was a beehive basin that was full of silt that consisted of the filter fabric when it was <br /> constructed. But was cleared after poking through it. There's a huge 50 x 30 brand new <br /> underground leaching galley that will provide enough storage. The site plan was revised but only <br /> one copy was available at the meeting. Mr. Ojala said that the Board could approve the plan <br /> contingent upon approval from Mr.Pesce. The other concern was a drainage manhole on Industrial <br /> Drive that had an extra catch basin which flows into an infiltration basin. There's a series of three <br /> and a very robust system and dry enough after the 4 inches of rain. The west comer also has an <br /> extensive drainage system in that retention area as well. All the road run-off will be contained on <br /> the property, so there will be no runoff into the streets. All these systems were designed by Baxter <br /> Nye Engineering.Mr. Ojala would like approval of the erosion control plan which shows the apron <br /> that Mr. Pesce requested as part of the application package. <br /> 8 <br />
