MEETING MINUTES <br /> MASHPEE ZONING BOARD OF APPEALS <br /> JANUARY 25,2023 <br /> 4. For remaining construction inspections outside of the review of the grading and <br /> drainage easement area adjacent to the proposed driveway entrance Plan Review <br /> recommends inspections be conducted by the design engineer, Mr. Ojala, with <br /> stamped written reports provided to the Board of Appeals for its files certifying that <br /> construction was completed in accordance with the approved plans. <br /> 5. No outside storage of materials unless otherwise approved by the Board of Appeals <br /> with a modification to any special permit that may be issued. <br /> Mr. Reidy read the comments submitted by Catherine Laurent, DPW Director dated January 25, <br /> 2023 into the record; "I am in agreement with Ed's report with one correction. Commercial Street <br /> is the only Town-owned road so DPW will only assume maintenance of the drainage structures <br /> in the southwest corner of the drainage easement on the property (overflow for the catch basins <br /> on Commercial Street). Industrial Drive and Mercantile Way are both private roads so the <br /> association or businesses on those roads are responsible for maintenance of their associated <br /> drainage." <br /> Mr. Furbush read Mr. Pesce's comment regarding the DPW Director's concerns that Mr. Ojala <br /> provide an erosion control plan at a later date. <br /> Mr. Furbush wanted to know if there is a maintenance plan established for the site. Mr. Ojala <br /> said yes, an O&M plan is in place and recommended an annual mowing of the site. Mr. Pesce <br /> recommended that this be provided for both the southwest corner and northwest corner. <br /> The Board had a discussion and would like to know how this maintenance plan could be enforced. <br /> Mr. Junqueira said that Capewide Construction has a maintenance contract for these sites. <br /> Capewide establishes a one year contract with the owner of the businesses. It would be up to the <br /> owner to establish their own after that year. <br /> Mr. Pesce mentioned that the O&M plan that was included in the submittal does refer to <br /> maintaining the storm water detention areas, and making repairs as needed. The dry wells should <br /> be repaired as needed to restore function. Mr. Pesce said that if the systems fail the flow will be <br /> on the property. <br /> Mr. Ojala said that there are building mounted lights at the cable ends with down cast and are <br /> dark sky compliant. There are no separate poll lights. The sign will have small lighting which is <br /> located on the left side of the driveway at Commercial Street. The applicant will be required to <br /> submit their sign to the Design Review Committee. <br /> The Board had a discussion that if any new tenants occupy the remaining contractor bays would <br /> be under the discretion of the Zoning Enforcement Officer to determine the granting authority. <br /> There were no more comments from the Board. <br /> 10 <br />
