MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 26,2023 <br /> Mr. Morris said the stairs were submitted for zoning because of the typography, and require a <br /> building permit and inspections. The pier and float system are exempt from zoning. <br /> Chairman Furbush polled the Board for further comments or questions. <br /> Ms. Sangeleer read the Conservation Department comments dated April 25, 2023 into the record: <br /> "This project was approved and issued an order of conditions by the Conservation Commission. <br /> Project meets performance standards for pathways under Regulation 29 (Buffer Zones and Buffer <br /> Strips). Dock meets standards under Regulation 27 (Docks, Piers and Floats). A condition of the <br /> approved dock is payment of a shellfish mitigation fee in the amount of$10,500 (payable to the <br /> Town of Mashpee)PRIOR to construction of the pier, ramp and float(condition 97 of the order of <br /> conditions under DEP file #43-3215)". <br /> Ms. Sangeleer read the Board of Health comments dated April 21, 2023 into the record: "No <br /> comment for the dock". <br /> There were no comments from the audience. <br /> Mr. Bonvie asked Attorney Kirrane for the Variance application request. He confirmed it would <br /> be 50 ft. <br /> Mr.Bonvie made a motion that the Board close the hearing to public comments for 28 Quaker Run <br /> Road, for Diane Wells,Trustee seeking a Variance from Section 174-33. Ms. Sangeleer seconded, <br /> yes, Mr. Goldstein, yes, Mr. Bonvie, yes, Mr. Blaisdell, yes and Mr. Furbush, yes. All were in <br /> favor to close the hearing to public comments. There was no further discussion. <br /> Mr. Bonvie made a motion that the Board issue a Variance for 28 Quaker Run Road to Owner, <br /> Quaker Run Nominee Trust, Diane Wells, Trustee requests a Variance under §174-33 (Setback <br /> from wetlands) of the Zoning Bylaws to allow for construction of an access stairway to the dock <br /> on property located in an R-3 Zoning District,Map 83 Parcel 19,Mashpee,MA with the following <br /> conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Variance under <br /> Mass General Law 40A Section 10. <br /> 2. Site plan — Prepared for: Quaker Run Nominee Trust, Diane Wells, Trustee, 28 Quaker <br /> Run Road, Mashpee, MA. Sheet No.: 1 of 1, Date: November 23, 2022, Drawn by: MD, <br /> Checked by: MC, Prepared by: Cape & Islands Engineering, Drawing Title: Site And Pier <br /> Plan.
