MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 26,2023 <br /> 3. The Zoning Board of Appeals issues a Variance under Section 174-33 (Setback from <br /> wetlands) in the amount of. 50 ft. For clarity, 50 ft. is required for the setback shown on <br /> the plan is zero, and the applicant requested a setback in the amount of 50 ft. <br /> 4. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Conservation Commission comments. <br /> Ms. Sangeleer, seconded, yes, <br /> Mr. Goldstein,yes, <br /> Mr. Bonvie, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Furbush, yes. <br /> All were in favor of the Variance setback from wetlands. <br /> The Board had a discussion regarding requests of extending petition applications.Attorney Kirrane <br /> explained that an applicant can request an extension as long as the Board approves the extension <br /> request.The Board requires to make a decision within a certain amount of time,and if the applicant <br /> doesn't request an extension and the time has lapsed it would be considered a constructive grant. <br /> Sitting on this hearing are the three regular Board Members, Associate Members, Charlie Reidy <br /> and Robert Caggiano. <br /> 31 Wheelhouse Lane: Owners, Jack Foster, Allyson Poole-Foster, and Lauren C. Foster request <br /> a Special Permit under §174-17.1; §174-17; §174-33 of the Zoning Bylaws, and M.G.L. c. 40A <br /> Section 6 to raze a pre-existing, non-conforming single-family structure and replace it with a new <br /> single-family structure on property located in an R-3 Zoning District (Little Neck Bay), Map 120 <br /> Parcel 165, Mashpee,MA. <br /> Attorney Christopher Kirrane represented the application for the raze and replace project. Also <br /> present was Tim Luff, with Archi-Tech Associates, and Raul Lizardi-Rivera with Cape & Islands <br /> Engineering. <br /> Attorney Kirrane said that if the Board was so inclined to close and vote on this hearing tonight, <br /> he would withdraw the request under §174-17 and MGL 40A Section 6 as done at the previous <br /> meeting. He is asking for other forms of relief in this case and if the project was continued due to <br /> the possible bylaw changes. <br /> Mr. Blaisdell suggested to Attorney Kirrane that the case be heard under Section 174-17.1 and if <br /> the Board is in favor he can withdraw Section 174-17. Attorney Kirrane agreed. <br /> 4 <br />
