<br />MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />MAY 10, 2023 <br /> <br />Mr. Furbush wanted to make sure that the plan that was submitted is the actual proposed building <br />with the four bays. Mr. Morris said that the Board doesn’t need to be too concerned as long as it <br />meets the zoning requirements. Mr. Pastore is occupying two of the bays. <br /> <br />Mr. Goldstein has no issues. Mr. Dibb pointed out that the rectangles on the site plan depict the <br />bathrooms. <br /> <br />Mr. Furbush polled the Board for comments. Mr. Reidy wanted to comment in terms of the <br />procedure. At the last meeting, part of the Board’s issue was the information from the Design and <br />Plan Review Committee, but all the Board had relative to how it was presented didn’t comply was <br />oral communication. He said that what Mary Ann prepared was the information once the Design <br />and Plan Review Committee makes their recommendations, and then submit that for the Board is <br />wonderfully helpful. It focuses on what is required for the Board. Mr. Reidy thanked the applicants <br />and Mary Ann. <br /> <br />Mr. Furbush polled the Board for further comments. There were no more comments from the <br />Board or audience. <br /> <br />Mr. Goldstein made a motion to close the public comment for 40 Evergreen Circle for the <br />Modification to the existing Special Permit. Mr. Ganzenmuller seconded, yes, Mr. Reidy, yes, Mr. <br />Caggiano, yes, Mr. Goldstein, yes, and Mr. Furbush, yes. All were in favor to close the public <br />comments for the Modification. <br /> <br />Mr. Goldstein made a motion to close the public comment for 40 Evergreen Circle for the Variance <br />request. Mr. Ganzenmuller seconded, yes, Mr. Reidy, yes, Mr. Caggiano, yes, Mr. Goldstein, yes, <br />and Mr. Furbush, yes. All were in favor to close the public comments for the Variance request. <br /> <br />Mr. Goldstein made motion that the Board approved 40 Evergreen Circle, Petitioner, Pastore <br />Excavation, Inc. requests a Modification to an existing Special Permit (SP-2021-34) under §174- <br />25 (G) (14); §174-24 (c) (9) (b); §174-45.6; §174-37; §174-41 (M) of the Zoning Bylaws to allow <br />for construction of a metal commercial building with contractor bays on property located in the I- <br />1 and Light Industrial Overlay District(s), Map 19, Parcel 10-4, Mashpee, MA. (Owner of record: <br />Chapter Closed, LLC) with the following conditions: <br /> <br />1. The Board has determined that the applicant meets all the conditions of a Special Permit <br />under Mass General Law 40A Section 9. <br /> <br />2.
