Conditioned on all Town Department comments read into the record including but not <br />limited to the Fire Department and Board of Health. <br /> <br />5. Conditioned on the recommendations from the Design and Plan Review Committees read <br />into the record at the ZBA meeting on April 26, 2023. <br /> <br />6. Conditioned on Pesce Engineering & Associates peer review report dated April 20, 2023, <br />and May 5, 2023. <br /> <br />7. Prior to the request of a building permit, the applicant shall issue a working capital account <br />in the amount of $5,000. The check shall be issued to the Town of Mashpee to be utilized <br />to pay for the initial peer review, and for future peer review inspections and signoffs. <br /> <br />8. Any changes in the use of the building bays will require an application with the Zoning <br />Board of Appeals. <br /> <br />Mr. Ganzenmuller seconded, yes, <br />Mr. Reidy, yes, <br />Mr. Caggiano, yes, <br />Mr. Goldstein, yes, <br />Mr. Furbush, yes. <br />All were in favor to issue a Modification to the Special Permit. <br /> <br />40 Evergreen Circle: Petitioner, Pastore Excavation, Inc. requests a Variance from the front yard <br />setback under §174-31 (Land Space Requirements) of the Zoning Bylaws to allow for construction <br />of a metal commercial building with contractor bays on property located in the I-1 and Light <br />Industrial Overlay District(s), Map 19, Parcel 10-4, Mashpee, MA. (Owner of record: Chapter <br />Closed, LLC) with the following conditions: <br /> <br />1. The Board has determined that the applicant meets all the conditions of a Variance under <br />Mass General Law 40A Section 10. <br /> <br />2. Proposed Site Development Plan, Prepared for: Nicholas A. Pastore, Project: 40 Evergreen <br />Cir. Mashpee, MA, date: March 10, 2023.
