The Board issues a Variance in the amount of one (1) ft. <br /> <br />Mr. Reidy seconded, yes <br />Mr. Caggiano, yes, <br />Mr. Ganzenmuller, yes, <br />Mr. Goldstein, yes, <br />Mr. Furbush, yes. <br />All were in favor to issue a Variance. <br /> <br />NEW HEARINGS <br /> <br />41 Waterline Drive South: Owner, 41 Waterline Drive, LLC requests a Written Finding under <br />§174-17 and §174-33 of the Zoning Bylaws to allow for construction of a deck addition on property <br />located in the R-3 and Little Neck Bay Cluster Subdivision Zoning District(s), Map 120 Parcel <br />149, Mashpee, MA. <br /> <br />Attorney Christopher Kirrane represented the homeowners requesting a very modest 105 sq. ft. <br />expansion to an existing deck located in the rear of the property that will bump out below the <br />length of two windows shown in a photo that was submitted to the Board. The project was <br />approved by the Conservation Commission. The homeowners would like easier access and slightly <br />more space on their existing deck. There are no proposed stairs on the deck extension. The structure <br />is non-conforming as to the setbacks to wetlands, one side yard setback and the front yard setback. <br />The lot is entirely located within in LSCSF and is also non-conforming as to lot coverage. The <br />deck will be approximately 35 ft. from the top of boarding vegetative wetlands (BVW). The deck <br />is raised off the ground and is not considered substantially more detrimental than what currently <br />exists to the neighborhood. <br /> <br />Chairman Furbush confirmed that the lot coverage is under the 30% lot coverage in the Little Neck <br />Bay Cluster Subdivision, and the structural lot coverage is 100% because it’s in a flood zone. He <br />didn’t have any issues. <br /> <br />There were no more comments from the Board. <br /> <br />Ms. Sangeleer read the Conservation Department comments dated May 8, 2023 into the record: <br />“No removal of vegetation within the buffer strip allowed from this deck expansion.” No <br />comments from Board of Health. <br /> <br />11 <br /> <br /> <br />
