<br />MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />MAY 10, 2023 <br /> <br />Ms. Sangeleer read the Conservation Department comments dated May 8, 2023 into the record: <br />th <br />“The conservation commission approved this project at their February 9 public meeting and <br />issued an order of conditions (permit). This project meets the performance standards for <br />Regulation 25 (Land Subject to Coastal Storm Flowage) the proposed new house footprint setback <br />was increased from the wetland edge from the existing home. The new deck required mitigation <br />to enhance a diminished naturally vegetated buffer zone. Garage proposed in previously/legally <br />altered areas.” <br /> <br />Ms. Sangeleer read the Board of Health comments dated May 9, 2023 into the record: “Septic <br />approved for five (5) bedrooms.” <br /> <br />There were no more comments from the Board or audience. <br /> <br />Mr. Goldstein made a motion to close the public comments for 411 Monomoscoy Road. Ms. <br />Sangeleer seconded, yes, Mr. Pittsley, yes, Mr. Caggiano, yes, Mr. Goldstein, yes, and Mr. <br />Furbush, yes. No further discussion. <br /> <br />Mr. Goldstein made a motion that the Board approve 411 Monomoscoy Road, Owner, MT Guard, <br />LC requests a Special Permit under §174-17.1 of the Zoning Bylaws to raze and replace a pre- <br />existing, non-conforming single-family dwelling with a detached garage and second floor <br />accessory apartment on property located in an R-3 Zoning District, Map 124 Parcel 61-0, Mashpee, <br />MA with the following conditions: <br /> <br />1. The Board has determined that the applicant meets all the conditions of a Special Permit <br />under Mass General Law 40A Section 9. <br /> <br />2.
