Mr. Seabury <br />stated that the regulation is comprehensive and clearly written for the public’s consumption. <br /> <br />A vote will take place at the next meeting. <br /> <br />5. Review of Callies Beach Sampling Variance <br />Mr. Seabury is requesting a reduction of Callies Beach sampling. This has been approved by <br />variance since 2007. DPH allows for reduced sampling after 4 consecutive years of low bacteria <br />levels. <br /> <br />Mr. Livingston was in favor due to cost savings. <br /> <br />Mr. Livingston made a motion to authorize the health agent to submit, to approve, and sign an <br />application for extension of the sampling variance for Callies Beach in Mashpee which was <br />seconded by Mr. Raposa. <br />Roll Call Vote: John Livingston (Yes) Ed Raposa (Yes) Ernie Virgilio (Yes) <br />Unanimous (3 – 0) <br /> <br />6. Discussion of Regulation of Abandonment of Systems. <br />Mr. Seabury was asked by the Zoning Board of Appeals about systems that are abandoned due to <br />a razed and rebuilt structure. Going forward, the old abandoned system will generally have to be <br />upgraded to today’s code. Providing some flexibility, a homeowner can ask for “extension of the <br />abandonment” to reconnect sewer system. Otherwise, if the BOH does not approve (if for <br />example in the 300-buffer zone) will have to have an I/A system installed. <br /> <br />Mr. Seabury noted that this MA regulation has been around but not implemented. However, Mr. <br />Seabury stated that the BOH will start to enforce by regulation. Once approved by BOH it will be <br />sent to the DEP to have on file. <br /> <br />Additional Topics: <br /> <br />General Comments were opened by Ernest Virgilio, Chair. <br /> <br />Mr. Seabury got a town counsel opinion that refuse hauler construction and demolition (C&D) is refuse <br />requiring a permit. Therefore, C&D is under the jurisdiction of the BOH. The goal is to know who is in <br />town and where the refuse is going. There have been problems in the past for the Town that needed to <br />be addressed. <br /> <br />In two meetings, Mr. Seabury will have new refuse hauling regulations written up. Mr. Seabury noted C&D <br />is a tough situation and must be monitored in some way. <br /> <br /> <br />
