Mr. Lehrer said it would be a <br /> waiver from the Zoning Board of Appeals. <br /> Attorney Kirrane said that they do exceed the required parking but there's potential that <br /> the uses may intensify the need for more parking. <br /> Evan Lehrer Town Planner <br /> Mr. Lehrer in his opinion there is not enough area in the rear portion on the southerly <br /> boundary that is paved leading up to that bio-retention rain garden but the extra spaces <br /> eliminate as many of the front parking spaces that is possible. There seems to be a fair <br /> amount of room available on the paved surface area. The parking should be on the side <br /> or rear if possible. <br /> Mr. Lehrer said that the bylaw essentially encourages, and suggests that parking should <br /> be on the rear and side, but the bylaw does provide latitude for the Board to say that in <br /> this case it doesn't necessarily work for specific reasons such as safety, public health, <br /> community facilities, etc. The Zoning Board can ask about the conditions that would <br /> necessitate the reason for parking in the front. <br /> Attorney Kirrane mentioned that there will be two spaces per contractor bay. If there is a <br /> different use besides contractor bays a proposal would be required to appear before the <br /> ZBA. There is no outside storage request at this time. <br /> Mr. Dibb said that the Design Review requested six (6) trees to be planted along the <br /> parking and the basin, and prepare some landscaping along the side. <br /> Mr. Lehrer mentioned that in this particular subdivision over the past few years of <br /> development the line of site between the main street intersections is starting to look nice. <br /> So in addition to what Design Review recommended might be prudent to include side <br /> vegetative grass buffer strips along the easterly portion of the lot line with native trees. <br /> Mr. Morris asked if the applicant is requesting to eliminate the need for the setback <br /> variance. Mr. Lehrer suggested that the applicant evaluate based on the Fire Department <br /> recommendations for a sprinkler system whether or not if they choose to have a sprinkler <br /> system. If they do not want the sprinkler, what will they need for the overall gross floor <br /> area of the building, and if they can remove the necessity for the variance. <br /> 2 <br />
