Representative: NOI <br />Marsh Matters Environmental (Owner of record: MC Massachusetts Nom) (continued from <br />3/23/23 & 4/6/23) <br /> <br />The applicant went through a series of changes that addressed the Commissioners prior <br />concerns. Mr. Cook noted that the applicant took care of the concerns from the last meeting. <br />Mr. Colombo asked that an agent be there for the pool excavation. Mr. Colombo thanked <br />the applicant for their revisions. <br /> <br />Mr. Kent noted the revised project reduces the overall scope of work, increases original <br />setback from top of coastal bank and increases proposed mitigation to meet required <br />mitigation standards for the two waiver requests. The first waiver addresses the unauthorized <br />clearing coastal bank vegetation conducted by the current homeowners. The second <br />mitigation trigger is from the proposed project itself as part of the waiver request. Although <br />there is no compelling need for a pool, the overall project scope is proposed over existing <br />lawn and is relatively minor in scope. As far as actual impact to the coastal bank and <br />associated performance standards, the project will not result in an adverse impact to the <br />bank itself in terms of wildlife habitat, alteration of drainage patterns and bank stability. Mr. <br />Kent noted the pool drawdown could be conditioned to address any concerns. Ms. Zollo was <br />concerned about the possibility of additional trees being taken down. Mr. Kent noted that <br />that it would require replacement in kind. <br /> <br /> <br />Ms. Zollo asked how root damage would be handled (would be replaced in kind) <br /> <br />Mr. Cook made a motion to close and issue with the conditions submission of a signed three- <br />year mitigation maintenance and monitoring contract between the homeowner and a <br />qualified wetland consultant, horticulturalist or landscaper to the Conservation Department <br />prior to any building permit, no drainage into a wetland resource at any time, use of a pump <br />truck for pool water drawdown, the work on the Coastal bank to be done manually by hand, <br />no machinery (track or wheeled machinery), agent site visit during excavation to review any <br />damage to coastal bank or trees, and any tree, if damaged, to be replaced in kind which <br />was seconded by Ms. Zollo, <br /> <br />Roll Call Vote <br />Alexandra Zollo (Yes) <br />Steve Cook (Yes) <br />Marjorie Clapprood (Yes) <br /> <br />
