MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 14, 2023 <br /> Ms. Beth Hennessey, Pirates Cove resident asked the Board to supplement a tree lined (Eastern Red <br /> Cedar) buffer in front of the stockade fence along Mashpee Neck Road. Ms. Hennessey does not want <br /> heavy equipment or trucks moving boats on the proposed property between 8 am and 5:30 pm. She <br /> also requested that the proposed lighting be a condition as recommended by the peer review engineer. <br /> Ms. Wendy Williams, resident of Mashpee Neck Rd. Ms. Williams voiced her concerns regarding the <br /> construction projects, the number of slips, and the degrading water quality. She handed out an article <br /> to the Board regarding the pollution. <br /> Margaret Marston, 16 Jackbon Rd. She asked if there were stickers distributed by the owner of the <br /> marina. She also had concerns with the traffic. <br /> Chairman Furbush allowed one more resident to speak. <br /> Jim Cornella, Pirates Cove. He had a question if the marina allowed overnight on the boats. <br /> Chairman Furbush announced he will allow more public comments at the continued hearing. <br /> Attorney Kirrane asked the Board to continue the hearing until the next public hearings dated June 28, <br /> 2023. <br /> Mr. Bonvie made a motion that the Board continue the hearing as requested. Mr. Goldstein, yes, Mr. <br /> Reidy, yes, Mr. Bonvie, yes, Mr. Blaisdell, yes, and Mr. Furbush, yes. All were in favor to continue <br /> the hearing until June 28, 2023. <br /> 12 & 16 Po onesset Island Road: Owners, The Popponesset Island Road LLC and Jonathan <br /> Bernstein, Trustee of 16 Popponesset Island Road Realty Trust requests a Special Permit under§174- <br /> 17.1 and §174-33 of the Zoning Bylaws to raze two existing dwellings, and construct one new <br /> conforming dwelling on the combined lots on property located in an R-3 Zoning District, Map 105 <br /> Parcel 265 and Map 105 Parcel 266, Mashpee, MA. <br /> Sitting on this hearing are the four regular Board members and Associate Member, Robert Caggiano. <br /> Attorney Mike Ford represented the raze and replace application. Also present was Mark Dibb, Cape <br /> & Islands Engineering, and the Architect. Attorney Ford mentioned that the two properties are owned <br /> by the same person. Attorney Ford mentioned that under the bylaw Section 174-17.1 includes the <br /> wetlands setback for this project. <br /> The existing conditions plan depicted both homes; 12 Popponesset is a one-story house that is slightly <br /> over 2,300 sq. ft. and was built in the 1940's. The existing house on 16 Popponesset was built around <br /> 2006, and is a two-story house, is 7,500 sq. ft. Attorney Ford referred to the"Ross Case"that both lots <br /> are non-conforming. The proposal is to raze both structures and rebuild an eleven-bedroom home. The <br /> proposed plan depicted the merge of the two lots, and the elimination of the common lot line between <br /> the two properties, and placing both the parcels in common ownership. <br /> 9 <br />
