MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 14, 2023 <br /> The requested use is for the marina owner, and family, or an employee and his family, and office use <br /> that is an accessory for the marina only. There are no other uses proposed. This project was presented <br /> to Site Plan Review Committee, and it was unanimously recommended by the Committee. The Fire <br /> Department had no issues with the storage of boats,and were adamant that the Department could handle <br /> any issue that may occur at the facility. The Harbormaster commented that this is a first class facility, <br /> and no issues. The Board of Health commented that the current system cannot be driven on, so the <br /> septic system will be upgraded to an I/A System. The Health Department wanted the applicant to <br /> continue to use the bathroom trailers as it is currently to not overload the resident septic system. <br /> The Plan Review Committee suggested that Mr. Ed Pesce, Engineering Consultant review the project <br /> on behalf of the Board. Mr. Dibb had several calls and discussions with Mr. Pesce and there were just <br /> three minor items. Mr. Pesce wanted to see the water quality calculations, the height of the light poles <br /> on the plans,and if the adjacent property were to be developed that those light poles would have guards <br /> to screen the undeveloped land. <br /> Chairman Furbush asked when the marina was first developed. Mr.Tim Leedham,Owner of the marina <br /> and the subject property on Mashpee Neck Road addressed the Board. Mr. Leedham said that he <br /> believes the marina was first developed in 1971 by the former owners of the residential property on <br /> Mashpee Neck Road. Mr. Leedham said that the marina had been through a few ownerships. He <br /> purchased the marina property in December 2001, and has renovated the marina over the past 20 years <br /> between 2007 and 2019. The Board approved the boat slip expansion back in 2020. There are a total <br /> of 154 slips, and he is not asking to expand the dock slips, or expand the marina. Mr. Leedham said <br /> that he wants to accommodate his customers during the peak seasons. He believes that his proposal <br /> will not add traffic to the community but will reduce the amount of traffic on Mashpee Neck Road and <br /> will avoid vehicles shuttling people to and from the marina. <br /> Chairman Furbush asked if there is fuel available for the marina customers. Mr. Leedham said; yes, it <br /> is located next to the launch ramp. The fuel is available for the marina customers as well as anyone <br /> from the area that stops by to re-fuel their boats with gasoline. There is no diesel available. <br /> Chairman Furbush asked the process to capture fuel spills because some facilities require a tight tank <br /> to capture any fuel or hazard spills.Mr.Leedham said that there are certain regulations that an attendant <br /> be at the fuel area, and he has never had an issue. <br /> Mr. Bonvie mentioned he spoke to Mr. Pesce regarding any potential spillage issues on a gravel <br /> driveway at the proposed driveway of the residence. His concerns are the drainage and possible <br /> spillage,as well as maintenance of a rain garden collection area.He said he is relying on the engineering <br /> provided by Mr. Pesce. Mr. Bonvie mentioned that there has not been any final approvals provided by <br /> Mr. Pesce. The Board of Health and the Fire Department has supplied there comments and conditions, <br /> but as one member,he is waiting on Mr. Pesce. <br /> Mr. Reidy read the comments submitted by Mr. Pesce at 4:53 pm on June 13, 2023 into the record. <br /> 6 <br />
