MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 14, 2023 <br /> Attorney Kirrane mentioned that there were emails and comments provided by Mr. Pesce as late as <br /> 5:00 pm on Wednesday. He didn't want the Board to think that his client was delinquent. <br /> Mr. Bonvie said as one member he wants to see a final site plan that peer review accepts and approves <br /> for the residents of this community, and that all the issues have been finalized and completed. <br /> Mr. Reidy mentioned he reviewed the site and noticed the elevation of the proposed parking area of <br /> the residence is a lot higher. He asked who and when approved the marina parking lot. Mr. Leedham <br /> said that the Zoning Board approved it back in 2019. Mr. Leedham described the details and <br /> engineering of that was done at the marina site. <br /> Mr. Reidy commented that the Board may not know if the proposed parking area will have the same <br /> protections as the marina parking area. He believes that the Board cannot make a determination on an <br /> engineering sense that what will be installed at the parking area is adequate to and consistent with the <br /> marina parking area. <br /> Mark Dibb said that Mr. Pesce's review was submitted on June 13th. Mr. Dibb said that he did respond <br /> in the morning of June 14t'. Mr. Dibb said that Mr. Pesce responded at 4:59 pm on June 14t' that he <br /> was reviewing the landscape plans, and the lighting plans. He said all of his previous site plan review <br /> comments had been satisfactorily addressed. There were a couple of remaining comments, one was the <br /> lighting plan, and the water quality calculations. Mr. Pesce recommended that any revised plans as a <br /> result of Conservation as part of the project. <br /> Mr. Dibb mentioned that Drew McManus recommended that this project should be reviewed and <br /> approved first by the ZBA before going to Conservation. <br /> Mr. Bonvie mentioned as one member that he has an issue with that statement because if there are any <br /> changes, additions, subtractions to these plans would require the applicant to return to this Board. He <br /> mentioned he had a conversation with Drew, and said that if there are any changes to the plans will <br /> require the applicant to return to the ZBA. <br /> Mr. Furbush said that the Board bases their decisions when all comments are submitted to the Board. <br /> As the Chairman, if anything is incomplete it does not work with him. <br /> Mr. Bonvie wanted to know if the State Spec is located on the plan. Mr. Dibb said it is on the plan. <br /> Mr. Reidy mentioned that he applauds the interest from the community, and appreciates that the <br /> applicant is willing to listen and tries to work with the people that have concerns and for those that are <br /> in favor. But the Board can't make a decision without final approval of the technical requirements. <br /> Mr. Furbush asked if storage of boats are over the winter. Mr. Leedham that generally the boats are in <br /> the put into the water around April 1",and are pulled out of the water in November. Mr.Furbush asked <br /> if the marina gravel parking lot has the proper material to capture any fuel spills. <br /> 7 <br />
