MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 28, 2023 <br /> Attorney Christopher Kirrane represented the owners of 17 Bowsprit Point for a Written Finding <br /> to make alterations to a pre-existing, non-conforming residence that is located in the R-3 Zoning <br /> District. This lot has several non-conformities. The front yard setback is non-conforming because <br /> it is 21.4 ft. from the property line, and the requirement is 40 ft. The rear yard setback is 20 ft. and <br /> is a conforming condition. The side yard setback is 14.4 ft. from the southerly side, and is a non- <br /> conforming condition where 15 ft. is required. There is 300 sq. ft. of lot land is subject to LSTCSF <br /> (Land Subject to Coastal Storm Flowage),which is existing at 100%lot coverage. The lot contains <br /> 9,200 sq. ft. of total land, but only 300 sq. ft. is outside the LSTCSF, and setback to wetlands is <br /> zero. <br /> Attorney Kirrane provided his written presentation that included photos of the proposed work areas <br /> of the existing home that include the following: <br /> A. Enclose and widen the front entry way. <br /> B. Push out the living space in the front of the house where the boxed in window is located so <br /> that it is even with the existing footprint of the house. <br /> C. Adding a first-floor deck to the rear(northeast side) of the house. <br /> D. Moving the existing deck stairs to the east side of the house. <br /> E. Expanding the second floor living space at the rear of the property over the footprint of the <br /> existing deck. <br /> Attorney Kirrane stated that this project is not creating any new non-conformities, and not <br /> intensifying any non-conformities except for the lot coverage. The front yard setback is not <br /> changing, the rear yard setback is not changing, and the side yard setbacks are not changing. The <br /> northerly side will become 17.7 ft. but is still a conforming condition. The lot coverage is <br /> increasing from 17.8%to 19.98%, but is still under the 25% for lots under 10,000 sq. ft. <br /> Chairman Furbush asked if the distance from wetlands is remaining the same. Attorney Kirrane <br /> said yes. <br /> Attorney Kirrane mentioned that this project was approved by the Conservation Commission. <br /> There were no comments from the Board or audience. Chairman Furbush asked for a motion to <br /> close the public comments. <br /> Mr. Bonvie made a motion to close the public comments of this hearing for 17 Bowsprit Point, <br /> Owners, Jay C. and Kristy M. Willadsen request a Written Finding under §174-17 and §174-33 of <br /> the Zoning Bylaws. Mr. Caggiano seconded, yes, Mr. Reidy, yes, Mr. Bonvie, yes, Mr. Blaisdell, <br /> yes, and Mr. Furbush, yes. All were in favor to close the public comments. <br /> 11 <br />
