MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 12, 2023 <br /> Chairman Bonvie wants the Board to determine if this is major or minor. He asked the Board if <br /> there were any additional comments from Town Departments, or any abutter comments, and if <br /> there were any changes or revisions from the previously approved documentation. <br /> Ms. Sangeleer read the Conservation Commission comments into the record comments dated July <br /> 11, 2023, "Project was approved by the Conservation Commission and issued an order of <br /> conditions on 8-29-22." <br /> Attorney Kirrane said that there was no abutter objection at the original hearing. <br /> Mr. Morris did not see any issues, and believes the Board can submit this project as a minor <br /> modification. He mentioned that the basement was not allowed and he would have denied the <br /> permit. He also said that a letter from FEMA was required. <br /> Mr. Blaisdell said that if the Board approves this project as a minor modification, but asked if <br /> Cape & Islands would revise the plan according to the new rules. <br /> Chairman Bonvie asked for further comments from the Board and audience. There were no more <br /> comments. <br /> Chairman Bonvie wanted the Board to understand the information to make a decision whether <br /> the project changes are major, minor or not allowed. He read Section 174-24 (9) on page 22 of <br /> the Zoning Bylaws into the record. <br /> Attorney Kirrane commented that there's a decrease of 5% of the lot coverage, and he is not <br /> changing the bylaw wording. <br /> Mr. Blaisdell agrees it's a minor modification. Mr. Ganzenmuller agrees that it's a minor <br /> modification. Mr. Reidy believes that a change to the basement to a crawl space could be <br /> considered a major or minor change. <br /> Chairman Bonvie mentioned that his concern to determine major or minor conditions is the <br /> advertisement. <br /> Mr. Morris mentioned that the only issue was receiving a letter from FEMA for the proposed <br /> basement. <br /> Attorney Kirrane said that the basement is a building code issue in his opinion, and believes that <br /> it is the responsibility of the Building Commissioner. There are no increases. <br /> Ms. Decter commented that she received a message from her neighbor at 45 Popponesset Island <br /> Road. Lisa Compton who fully supports the project. <br /> 11 <br />
