MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 12, 2023 <br /> Mr. Lake a direct abutter asked if there was any encroachment toward his property. <br /> Mr. Degnan explained that there is no encroachment. <br /> Mr. Furbush clarified that the 5.7 ft. extension for the garage is still within the allowed 15 ft. <br /> setback on Pembroke Drive. <br /> There were no more comments from the audience. <br /> Mr. Bonvie stated to the Board for the record that Cape & Islands knows the criteria required <br /> regarding wetlands. If the plan needs to be altered it should be submitted to this Board as part of <br /> the record. <br /> Mr. Bonvie informed the applicant to have a conversation with Cape & Islands asking them if the <br /> plan submitted to the Board reflects the recent criteria in regard to lot coverage calculations. If the <br /> plan does not reflect this request, they need to revise the plan, and if it does reflect the changes, <br /> than have the Cape & Islands representative send an email to the Board Secretary. <br /> Mr. Degnan asked if a heated room is under the Board's jurisdiction. Mr. Bonvie said; yes it is <br /> because the criteria may or may not be considered a bedroom. <br /> Mr. Bonvie asked for a motion to close the public comments. Mr.Reidy; so moved.Ms. Sangeleer, <br /> seconded. The Board voted all in favor to close the public comment. <br /> Mr.Reidy made a motion that the Board issue a Written Finding to Owners,Michael J.and Jennifer <br /> L. Degnan under§174-17 of the Zoning Bylaws to allow for deck additions, alterations,extensions <br /> to a pre-existing, non-conforming single family dwelling on property located in the R-3 Zoning <br /> District and the Popponesset Overlay District, Map 123 Parcel 55, Mashpee, MA with the <br /> following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2. Site Plan—Prepared For: Michael J. & Jennifer L. Degnan, 23 Pembroke Dr., Mashpee, <br /> MA.
