MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 12, 2023 <br /> This project will not be substantially more detrimental than what currently exits or use to the <br /> neighborhood. The proposed lot coverage is 22.9% and is well below the requirement of 25%. <br /> Mr.Bonvie asked Mr.Morris if the proposed enclosed deck in the rear will affect the rear setbacks. <br /> Mr. Morris stated for the record, that this is not creating a new non-conformity. <br /> Mr. Bonvie mentioned that there is an issue with the lot coverage in regard to a court case that <br /> involved areas Land Subject to Coastal Storm Flowage (LSTCSF). Mr. Bonvie explained that the <br /> Board was told by a judge to consider lot coverage to be reviewed that is included in the Zoning <br /> Bylaws. Cape & Islands Engineering needs to revise the site plan with the correct lot coverage <br /> depicting the Land Subject to Coastal Storm Flowage. <br /> Mr. Reidy noticed that the site plan is dated 2022, and is before the judge submitted the remand. <br /> Mr. Reidy believes that Cape & Islands is aware of this situation, and is aware of the application <br /> and what was supplied to the Board. <br /> Mr. Bonvie explained to the applicant that if any area of the lot is within wetland jurisdiction or <br /> flood plain,than the computation will change. It has nothing to do with Conservation. <br /> Mr. Degnan asked if it has any bearing on whether it is significantly detrimental to the <br /> neighborhood. Mr. Furbush said; no. <br /> Mr. Bonvie polled the Board for their comments. <br /> Mr. Blaisdell addressed the applicant and believes that he can have a discussion with Cape & <br /> Islands to revise the plan. Mr. Blaisdell said that there is no change in lot coverage, but the plan <br /> may need to be revised. <br /> Mr. Morris believes that there is no issue with the wetlands or lot coverage. <br /> Ms. Sangeleer asked for a condition that the mud room may not be winterized. Ms. Degnan said it <br /> will not be winterized. Mr. Degnan said that the front porch will be a screened porch, and will not <br /> be winterized. The mud room will just be enclosed and not heated. <br /> Mr. Morris said that the mud room is less than 70 sq. ft. Mr. Morris asked if the garage will have <br /> a deck above. Mr. Degnan said part of the deck is existing, and will be extending the deck 6 ft. to <br /> accommodate the width of a car. <br /> Ms. Sangeleer read the Board of Health comments into the record dated July 12,2023; "To remain <br /> a five (5) bedroom, no comments". Conservation Comments dated July 11, 2023 were read into <br /> the record; "This project was issued a negative determination (approval) by the Conservation <br /> Commission in October of 2022, and an email dated July 12, 2023 from Dan Kent, Assistant <br /> Conservation Agent; "RDA permit for deck addition and modifications to existing dwelling <br /> approved by Conservation Commission." <br /> 2 <br />
