MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 12, 2023 <br /> The original Special Permit had a condition that the proposed room above the garage to remain <br /> unheated. The modification noted a condition that stated, "The proposed room over the garage <br /> must remain unheated." Mr. Bings finished the second floor because the previous permit allowed <br /> him to. He plans on using this room as storage, and for his marine biology projects. The request is <br /> to remove condition five (5), and eliminate condition seven(7) from the original permit. <br /> Attorney Kirrane said that there is no plumbing being proposed; it's just storage. <br /> Mr. Morris inspected the house and signed off. He stated that the Board of Health comments states <br /> it all.No issues. <br /> Mr. Furbush asked why the original permit was conditioned as no heat. <br /> Attorney Kirrane believes that the previous Building Commissioner took the position that the <br /> second floor above the garage could not be finished. There was no bylaw from the Board for an <br /> Accessory Apartment, and now it is allowed. <br /> Mr. Furbush wanted to know the amount of bedrooms. Mr. Brings said that there is four (4) <br /> bedrooms. Mr. Furbush is very concerned that this will become an extra bedroom. <br /> Mr. Brings said that this room is not connected to the main house. <br /> Attorney Kirrane said that the condition in 2021 stated that the room must remain unheated. There <br /> was nothing mentioned that it remain unfinished. He believes that the modification was a <br /> typographical error. <br /> Mr. Morris said there's a set of stairs to a landing and there's a door to that space. <br /> Mr. Blaisdell stated as one member he is satisfied as long as Mr. Morris and the Board of Health <br /> are satisfied. <br /> Mr. Caggiano said that a condition can be made that it not be used as a bedroom.Mr. Ganzenmuller <br /> agreed. <br /> Ms. Sangeleer read the Board of Health comments dated July 12, 2023 into the record; "Finished <br /> storage cannot be used for Human Habitation (sleeping) no plumbing can be added. To remain 4 <br /> bedroom, and the Conservation Department comments; `property not within wetlands <br /> jurisdiction. " <br /> There were no continents from the audience. <br /> 5 <br />
