On the other hand there <br /> has to be some latitude for management.Agrees with what Mary says but doesn't want someone <br /> to misuse the wording. <br /> Greg McKelvey said you are also trusting the judgement of the person delegating. The wording <br /> doesn't need to be changed. <br /> Cathy Lewis recommended referring to the flow chart in the charter. <br /> John Miller has no objection to making the definition abundantly clear. But is qualified the right <br /> word. <br /> Darlene Furbush said that the article is authorizing the Town Manager to use his best judgement <br /> when delegating authority to qualified officers. So it should be unnecessary to change that. <br /> Mary Waygan asked about Town Counsel's definition of a Town Officer. <br /> David Weeden suggested adding to the definition "qualified relevant officer", also to strike the <br /> word any and change the definition to a qualified relevant subordinate officer instead of any <br /> subordinate officer. <br /> The Town Manager provided copies of Town Counsel's opinion on the definition of a Town <br /> Officer. The term "Town Officer" as defined in Section 1-7 of the Charter has historically been <br /> construed to include all elected and appointed members of Town boards, commissions, or <br /> committees established/authorized by statute,Charter or Bylaw; elected individual office holders <br /> (such as the Town Clerk); and appointed department heads (as "departments" are established <br /> within the Town's administrative organizational structure from time to time. This would not <br /> include assistant department heads. <br /> Section 4.4 Acting Town Manager <br /> Greg McKelvey asked if the definition of (a) Temporary Absence should include the Assistant <br /> Town Manager. <br /> The Committee discussed if the powers and authority of the Town Manager are automatically <br /> delegated to the Assistant Town Manager. <br /> John Miller also questioned if the Assistant Town Manager was addressed anywhere in the <br /> charter and if not they probably be? <br /> Rodney Collins said there should be a provision delegating the authority to the Assistant Town <br /> Manager if the Town Manager is incapacitated. <br /> Greg McKelvey also thinks the definition of part(a)should include "qualified town administrator" <br />
