Mr. Kent confirmed <br />that the pond is sandy with shells still there leading him to believe that.the beach area was <br />merely raked over. <br /> <br />Mr. Kent comments and recommendations were as follows – asking about the placement of <br />drywells as an option in addition to the proposed mitigation. <br /> <br />Mr. Cook asked about the standards – mitigation, compelling need, and safety and health <br />consideration. (Encroachment on an abutter). The change proposed was the landscaping to <br />address the Agent’s concern. In addition to the increased mitigation, changes to the include <br />changes to a retaining wall. The applicant noted that continuances were going out for a <br />month and the desire to use time for the plantings soon to make the plantings successful. <br />The applicant indicated that it preferred an approval conditioned with a new plan being <br />reviewed by staff but wanted to hear the Commissioners’ comments. Ms. Zollo noted there <br />was no need to see all the details and agreed there was no need for a continuance. Mr. <br />Cook sought clarification on the retaining wall. In response, Mr. Kent indicated the retaining <br />wall needed to be moved due to encroachment of a neighbor. (About 5” onto the abutter’s <br />property) and needed to be addressed immediately. <br /> <br />Mr. Kent comments were as follows: All changes to original plan fall within secondary Coastal <br />Bank per Mashpee’s bylaw. Alterations to the plan on the Northwest side of lot are not a <br />detriment to any resource areas due to the drywell installation and drainage managing <br />stormwater run-off. Proposed turf should be replaced with low maintenance vegetation (i.e <br />grass, clover, or other substitute) and arborvitae on Southeast lot line be substituted with <br />Eastern Red Cedar. A three-year signed mitigation monitoring contract be made with a <br />certified horticulturist for an approval. Agent recommends close and issue with the <br />conditions mentioned – working with staff. <br /> <br />
