MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
APRIL 28, 2021
Attorney Kirrane said that Lot 7 is a vacant lot. The rear section of Lot 8 is the marijuana
facility. A gate will be installed that is approximately 20 ft. wide, and will be locked at
night. There will be 6 to 8 trucks, and some machinery. There will be nothing stored on
Lot 8, but Lot 3 will have firewood logs, woodchips, and natural material from site work.
Mr. Govoni said the rear corner has a drainage basin that was installed, and will be
upgraded.
Chairman Furbush asked if a gate will be installed at Lot 8. He asked if there is a dumpster
stored in the rear corner of the lot.
Raul said that Lot 8 had been graded and cut down, and the rear corner is the lowest point
on the site. Currently there's a subsurface leaching pit, and that will be improved with a
penetrated retention basin to provide treatment for the subsurface leaching. When the water
level reaches about 12 inches, it drains into the subsurface leaching, and will be treated
with the basin before it drains.
Chairman Furbush asked if the vehicles will be idling anytime during the day or night, and
if there will be lights installed.
Mr. Govoni said that the vehicles are started up in the morning usually around 6:30-7:00
am, and they go right to work. There will be some lighting and cameras installed by an
electrician. Attorney Kirrane said that there is nothing shown for lighting at this point, but
will be installed at a later date.
Mr. Govoni said that the material is brought to a plant to be processed. There is only one
loader truck stored that will have this material. There is also an outhouse provided on Lot
3, as required by Board of Health.
Chairman Furbush read the requirements under the Special Permit bylaws asking if there
was any safety concerns. He is most concerned with any type of disturbance, noise, excess
vibration, etc. on the sites.
Attorney Kirrane said this is a passive use, and there will be no vehicles going in and out
on an hourly or minute basis. There is a fence behind Lot 3 that abuts Town property.
Sharon read the Board of Health comments for each lot. The Health Agent said his
comments from Plan Review still stand and shall be included in the ZBA Decision. Port-
o-pots to be included on each lot.
Sharon read the Town Planner comments into the record, and the Plan Review
recommendations.
Attorney Kirrane said most of the conditions were discussed, and his clients will agree to
the recommendations and conditions.
7
