MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 28, 2021 <br /> Mr. Gould seconded, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Ganzenmuller, yes, <br /> Mr. Furbush, yes. <br /> All were in favor <br /> Chairman Furbush announced that the four regular Board members and Associate, Charlie <br /> Reidy will be sitting in on the next two petitions. <br /> 30 Evergreen Circle: Petitioner, Evergreen Energy, LLC request a Special Permit under <br /> §174-25 G (13) of the Zoning Bylaws to allow for a contractor's yard, on property located <br /> in the I-1 and Light Industrial Overlay District(s), Map 19 Parcel 10-3, Mashpee, MA. <br /> 41 Evergreen Circle: Petitioner, Evergreen Energy, LLC request a Special Permit under <br /> §174-25 G (13) of the Zoning Bylaws to allow for a contractor's yard on property located <br /> in the I-1 and Light Industrial Overlay District(s), Map 19 Parcel 10-9, Mashpee, MA. <br /> Attorney Christopher Kirrane represented the petitioners Peter and Mark Govoni, who are <br /> the owners of both properties. Also present was Raul Lizardi-Rivera, with Cape &Islands <br /> Engineering. The two applications are similar for use as contractor yards which is an <br /> allowed use in the Industrial District with a Special Permit. The Owners are in the site <br /> clearing business that involves storage of heavy machinery equipment, earth materials, and <br /> construction type vehicles. The materials stored onsite are woodchips, logs, and natural <br /> earth material; all which are allowed in this Industrial Zone. <br /> Comments were submitted to Raul from the Design and Plan Review committees, and he <br /> revised the site plan as requested. <br /> Chairman Furbush asked if there are any proposed buildings going on these lots. Attorney <br /> Kirrane said; no, but there is a shed that already exists on Lot 8 (30 Evergreen Circle). <br /> Chairman Furbush mentioned that this project went to Design Review, and there were <br /> concerns raised if the proposed contractor's yards would negatively impact the neighboring <br /> businesses because the area has new industrial high end buildings; such as Cape Cod <br /> Coffee. <br /> Raul said that lot 8 which is (30 Evergreen Cir.) is directly abutting the lot that was just <br /> approved for Cape Cod Gutter Monkeys. The screening buffer will be situated along the <br /> front and side that faces Evergreen Circle, and Lot 7. The back side of Lot 8 will remain a <br /> natural vegetative buffer for about 25 ft. On Lot 3, which is (41 Evergreen Cir), will have <br /> the same screening, keeping the existing 15 trees in the front yard that is labeled "trees to <br /> remain", and there will be evergreen trees, as proposed for screening toward the back of <br /> the lot. At Design Review there was a request for a fence to be installed along the rear <br /> property line which is depicted on the site plan to keep the project from encroaching on the <br /> northern property. <br /> 6 <br />
