MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />OCTOBER 25, 2023 <br />Chairman Bonvie read comments into the record from Evan Lehrer, Town Planner and the <br />Community Development Director that were received just before the meeting started. To <br />summarize, Mr. Lehrer stated that the Board should review sections 174-17.1, and Section 174- <br />24.C.2 of the Zoning Bylaws in order to make a finding determination. <br />Mr. Reidy read the comments dated October 24, 2023 from the Board of Health into the record; <br />"New fast system approved for four (4) bedrooms in main house. " The Conservation Department <br />comments dated October 25, 2023; "The only update Conservation has is for 339 Monomoscoy <br />Road. The commission voted to close and issue the raze & replace for 339 Monomoscoy with <br />conditions in a 4-2 vote. Landscape plans to be revised to include 2,812 square feet of mitigation <br />in the 50' buffer zone per commission determination. <br />Attorney Kirrane stated he listed the specific enhancements that will be made to the lot and the <br />proposed new dwelling construction in his written presentation. He stated that there has been <br />substantial mitigation conditioned by the Conservation Commission. <br />Mr. Furbush asked if a revised landscape plan will be provided for the Board to sign off. <br />Attorney Kirrane did not provide the landscape plan. He believes it is not a zoning issue. <br />Chairman Bonvie stated as in prior applications when the Board makes a motion and it includes a <br />condition if there are changes to the plans i.e., removal of trees or shrubs will require the applicant <br />to return to this Board. <br />Attorney Kirrane said that if that is the case he will return to the Board, but he does not anticipate <br />that for this application. He stated that Conservation will be responsible for the revised landscape <br />plan, but the project was closed and his understanding is an order of conditions was issued. <br />Chairman Bonvie is concerned that the Board has not seen a revised plan, and believes that this <br />Board does require review of landscaping. He also stated that he wants to revise the <br />application/submittal requirements for petitioners. <br />Mr. Goldstein stated it is his opinion that Conservation approved the landscape plan. <br />Ms. Sangeleer asked if the new tree bylaw will be effected by this application. Chairman Bonvie <br />stated that will be reviewed by the Town Planner and the Building Commissioner at the time of <br />permitting. <br />The Board reviewed the proposed site plan and wanted clarification if the easement was affected <br />by the project. <br />Chairman Bonvie polled the Board for comments. Mr. Goldstein is satisfied with the placement of <br />the house, it's an improvement to the property, and is well under the lot coverage. <br />4 <br />
