A motion was made by Chair Thomas to support the Director of Natural Resources and the <br /> Shellfish Constable in suspending or revoking Mike Ronhock's aquaculture grant. <br /> Motion seconded by Mr. Christensen. <br /> VOTE: Passed 3-0-2 <br /> Motion passed by majority vote with Co-Chair Cook and Christopher Avis Abstaining. <br /> NEW BUSINESS: <br /> 1. Ownership Transfer of Mark Burtis Aquaculture Grant. <br /> The intent of this item is to inquire as to whether Mark Burtis is able to transfer ownership of his current <br /> aquaculture grant to his Son, Chris Burtis. <br /> Chris Burtis said that the rules and regulations state that the requirement is that the grant holder must <br /> reside in the Town of Mashpee twelve months out of the year and that he is currently a resident of <br /> Falmouth. However, he stated that he is a beneficiary member of the trust that operates 3.6 commercial <br /> acres of waterfront"the marina" at 15 Riverside Road. He went on to state that he structured an LLC out <br /> of the Town of Mashpee with the hopes of being able to shellfish under that LLC. <br /> Ashley Fisher stated that getting a legal opinion is a good starting point. <br /> Co-Chair Cook expressed concern of the precedent that would be set if this transfer were allowed and <br /> recommended that the Burtis' seek legal counsel of their own. <br /> Chair Thomas made a motion in support of the transfer of the Burtis aquaculture grant from Mark <br /> Burtis to Chris Burtis pending legal advice. <br /> Motion seconded by Mr. Christensen. <br /> VOTE: Passed 4-1-0 <br /> Motion passed by majority vote with Co-Chair Cook opposing. <br /> 2. Shellfish Constable Report. <br /> Chris Avis gave his monthly report stating that all seed orders have been fulfilled and he has started <br /> requesting pricing for the upcoming year. <br /> He reported that they have received 5,766,000 quahogs and 1,115,600 oysters this year. They will be <br /> propagating close to 7 million seeds. <br /> Chris stated that all bottom cages have been pulled from Thatch Island and will be getting cleaned. <br /> Thatch Island is opened for recreational and commercial shell fishing outside of the grant areas. <br /> All Flupsey docks and upwellers are full of quahogs. <br /> They are still waiting to hear from the DMF with regard to the area biologist replacement. <br /> There was a statewide precautionary closing of shell fishing due to tropical storm Lee. The storm didn't <br /> produce much rain and they were able to open up again at dawn the Sunday following the storm. <br /> The greenhouse at Little River got damaged by the wind from the storm and was repaired the same day. <br /> It was reported that the Pacheco site in Waquoit Bay was bottom tested with the DMF and that it appears <br /> as though it will pass. 74 holes were dug on the 1.9 acre site and only about 30 quahogs were found. <br /> Chris is hopeful that the fishery will open November I't if the DMF testing passes. <br /> Staffing remains the same but they will lose their seasonal help at the end of the month. <br /> 2 <br />
