MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 8,2023 <br /> 42 Wheeler Road: Owner,Marcio DeJesus requests a Special Permit under§174-17.1 and §174- <br /> 33 of the Zoning Bylaws to raze an existing single family dwelling and replace it with a new single <br /> family dwelling on property located in the R-5 Zoning District, Map 57, Parcel 7, Mashpee, MA. <br /> (Continued from October 25, 2023 hearings). <br /> Mr. Reidy read a letter dated November 8, 2023 from Attorney Christopher Kirrane that he is now <br /> representing the applicants and requesting a continuance until December 13, 2023. <br /> Mr. Reidy made a motion that the Board accept Attorney Kirrane's request for continuance for 42 <br /> Wheeler Road until December 13,2023,with an extension until December 31,2023 for the Board <br /> to render its Decision. Mr. Furbush second. All were in favor. <br /> 50 Ever reen Circle: Owner, Chapter Closed LLC requests a Special Permit under §174-25; <br /> §174-25 (G) (14); §174-24 (C) (2); §174-45.6; §174-37, and §174-41 (M) of the Zoning Bylaws <br /> to allow for construction of 9,672 sq. ft. contractor bay warehouse metal building on property <br /> located in the I-1 and Light Industrial Overlay District, Map 19, Parcel 10-5, Mashpee, MA. <br /> (Continued from October 25, 2023 hearings). <br /> Attorney Christopher Kirrane represented the applicant's request for a Special Permit to construct <br /> a 9,672 sq. ft.building consisting of eight contractor bays,and relief from the parking requirements <br /> under the zoning bylaws. Also present was Mark Dibb, with Cape & Islands Engineering. This <br /> project was presented on September 19,2023 to the Plan Review and Design Review Committees, <br /> and their recommendations have been incorporated in the design plan. This project has also been <br /> reviewed by Mr. Ed Pesce, Pesce Engineering who represented the Board for peer review of the <br /> engineering plans, site plans, landscape plans, and photometric plan. <br /> The site consists of 110,664 sq. ft. and has 128 ft. of frontage along Evergreen Circle. The building <br /> is a Morton style design building that will comply with current zoning. The Board can make a <br /> finding as indicated under Section 174-24, that the proposed use and development will not <br /> adversely affect public health or safety, will not cause excessive demand upon community <br /> facilities, will not significantly decrease surface or ground water quality or air quality, will not <br /> have a significant adverse impact on wildlife habitat, estuarine systems,traffic flow,traffic safety, <br /> waterways, etc. <br /> The Board reviewed the engineering plans depicting the zoning requirements, the parking <br /> requirements, and the revisions that were made during the peer review submitted by Pesce <br /> Engineering.Mr.Pesce provided his initial review for the Board as part of the record dated October <br /> 21,2023. The report indicated his review of the Site Plan,Layout and Utilities,Proposed Lighting, <br /> Landscaping, and Parking. The parking requirement increased from 18 spaces to 31 spaces to <br /> accommodate the square footage and septic design. <br /> s <br />
