Town of Mashpee <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> k'A <br /> , �'1V 0 <br /> To <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2023-20 <br /> Owner, MT Guard, LC Doc.: 1464755 <br /> 411 Monomoscoy Road Ctf.: 230709 <br /> Map 124 Parcel 61-0 <br /> Mashpee,MA 02649 <br /> A Petition was filed on February 8, 2023 by Owner, MT Guard, LC requesting a Special Permit <br /> under §174-17.1 of the Zoning Bylaws to raze and replace a pre-existing, non-conforming single- <br /> family dwelling with a detached garage and second floor accessory apartment on property located <br /> in an R-3 Zoning District, Map 124 Parcel 61-0, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on March 3, 2023 and March 10, 2023 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hail on Wednesday, March 22, <br /> 2023 at which time the following members of the Board of Appeals were present; Chairman, <br /> Jonathan Furbush,Board Members,Ron Bonvie, Scott Goldstein,Norman J. Gould,and Associate <br /> Member,Brad Pittsley.Chairman Furbush opened the meeting,and heard testimony from Attorney <br /> Guard and Raul Lizardi-Rivera with Cape & Islands Engineering. The Chairman thereafter <br /> continued the hearing to April 26, 2023 to allow time for the applicant to provide a floor plan of <br /> the proposed garage and a revised site plan. The hearing was continued further until Wednesday, <br /> May 10, 2023 to allow the Board additional time for scheduling purposes. <br /> On May 10, 2023,the continued hearing was opened, at which time the following members of the <br /> Board of Appeals were present and acting throughout; Chairman Jonathan Furbush, Board <br /> Members, Scott Goldstein, and Associate Members, Sharon Sangeleer, Brad Pittsley, and Robert <br /> Caggiano. Also present was David Morris, Building Commissioner. <br /> Attorney Steve Guard represented MT Guard, LC, the applicant for the Special Permit seeking to <br /> allow the raze and replace of the existing dwelling on 411 Monomoscoy Road. Also present was <br /> Raul Lizardi-Rivera, Cape & Islands Engineering, and Jeff Metcalfe, Architect. <br /> 1 <br />
