Giblin requesting a Special <br /> Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze and replace a pre-existing, <br /> non-conforming structure and replace it with a new single-family residential structure with <br /> associated pool, detached garage with guest suite above on property located in an R-3 Zoning <br /> District, at 90 Popponesset Island Road, Map 106 Parcel 34, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee, on March 3, 2023 and March 10, 2023. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> This hearing was scheduled to be heard at the Zoning Board meeting dated Wednesday, March <br /> 22, 2023, but was continued to April 12, 2023 hearings, to May 24, 2023, and again to the July <br /> 26,2023 hearings. The applicant submitted multiple continuances in writing to the Zoning Board <br /> and stated that the decision of the Conservation Commission had been appealed to the DEP, and <br /> the Zoning Board was unable to act until that appeal has concluded. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, July 26, <br /> 2023 at which time the following members of the Board of Appeals were present; Chairman, <br /> Ronald Bonvie, Board Members, Scott Goldstein, Jonathan Furbush, Sharon Sangeleer, and <br /> Associate Member, Charles Reidy. <br /> Attorney Christopher Kirrane represented the applicant for the Special Permit request. Attorney <br /> Kirrane reviewed the Conservation Department comments that were submitted. This project was <br /> appealed to DEP, and is now under review with the Massachusetts Environmental Policy Act <br /> (MEPA) who requires that the State Agencies study the environmental consequences of their <br /> actions, including permitting and financial assistance.) <br /> 1 <br />
