MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Ryan Lenhart and Kristen Lenhart <br /> 81 Bluff Avenue (Map 118 Parcel 60) <br /> Mashpee, MA 02649 <br /> SP-2023-26 <br /> • The proposed increase in building footprint is consistent with other projects that have <br /> been approved by the Board. <br /> • Construction of the dwelling is subject to and contingent upon Board of Health final <br /> approval. <br /> • The Bylaw requires two parking spaces for a residential structure. The impervious paved <br /> driveway is being replaced with a pervious stone driveway; and contains adequate land <br /> area to provide sufficient parking and setbacks, as may be required. <br /> The Board finds that no new non-conformities will be created by the project. <br /> In view of the foregoing,the Board determined that the Petitioner has met the criteria for a Special <br /> Permit pursuant to Bylaw §174-17.1; ie., that the proposed changes, extensions, alterations or <br /> reconstruction of the pre-existing non-conformities are not substantially more detrimental to the <br /> neighborhood than the conditions existing prior to removal of the existing structure, and that there <br /> is adequate land area on the subject lot to provide sufficient parking.The Board further determined <br /> that no new non-conformities are being created by the proposed project. <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday, April 26, 2023, the <br /> Zoning Board of Appeals voted unanimously to issue a Special Permit to Owners, Ryan Lenhart <br /> and Kristen Lenhart under §174-17.1 and §174-33 of the Zoning Bylaws, to raze a pre-existing <br /> non-conforming single-family dwelling and replace it with a new single-family dwelling on <br /> property located in an R-3 and the Popponesset Overlay Zoning District(s), at 81 Bluff Avenue, <br /> Map 118 Parcel 60, Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2.
