MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT MODIFICATION(SP-2021-34) <br /> Petitioner, Pastore Excavation, Inc. <br /> Owner, Chapter Closed, LLC <br /> 40 Evergreen Circle, (Map 19 Parcel 10-4) <br /> Mashpee, MA 02649 <br /> SP-2023-28 <br /> Chairman Furbush read Mr. Pesce's invoice dated May 9, 2023 into the record that listed his <br /> specific task descriptions and was approved by the Board. Mr. Furbush also mentioned that the <br /> Board received the O&M Plan with a signature to be stamped in for the record. <br /> Mr. Goldstein wanted to confirm the total amount of contractor bays in the building. Attorney <br /> Kirrane said; it's a four bay building and the plan indicated that each bay had a bathroom. The <br /> owner will occupy two of the bays. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Modification <br /> to an existing Special Permit. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday, May 10, 2023 the Zoning Board of Appeals voted unanimously to issue Petitioner, <br /> Pastore Excavation, Inc. a Modification to an existing Special Permit (SP-2021-34) under §174- <br /> 25 (G) (14); §174-24 (c) (9) (b); §174-45.6; §174-3 7; §174-41 (M)of the Zoning Bylaws to allow <br /> for construction of a metal commercial building with contractor bays on property located in the I- <br /> 1 and Light Industrial Overlay District(s), Map 19, Parcel 10-4,Mashpee, MA. (Owner of record: <br /> Chapter Closed, LLC) with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Proposed Site Development Plan,Prepared for:Nicholas A.
