MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO SPECIAL PERMITS) <br /> (SP-83-3-008, SP-00-167, SP-02-59, SP-2020-06) <br /> Owner,21 Frog Pond Close, LLC <br /> 21 Frog Pond Close (Map 90 Parcel 83) <br /> 352`Mashpee Neck Road (Map 90 Parcel 97) <br /> Mashpee,MA 02649 <br /> MOD-2023-32 <br /> Mr. Leedham stated for the record that the company that bought Bosuns Marine has no ownership <br /> interest in the Mashpec Neck Marina. <br /> Attorney Kirrane mentioned that he fully believes that his client has demonstrated the need for <br /> the parking. <br /> Chairman Furbush asked Mr.Bonvie to close the public comment.The Board voted unanimously <br /> in favor to close the public comment. <br /> Chairman Furbush read the Special Permit Bylaw Section 174-24(C)2,into the record and asked <br /> the Board to consider this bylaw when making their determination. <br /> There were no final comments. <br /> In view of the foregoing,the Board determined the Petitioner met the criteria for a Modification. <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday, June 28, 2023 the <br /> Zoning Board of Appeals voted unanimously to issue Timothy W. Leedham, Manager of 21 Frog <br /> Pond Close LLC,at 21 Frog Pond Close and 352 Mashpee Neck Road a Modification of an existing <br /> Special Permit for the use of the Marina and expand to include the adjacent property located at <br /> 352 Mashpee Neck Road. The original Special Permit was issued under the following entity: (SP- <br /> 83-3-008, SP-00-167, SP-02-59, and SP-2020-06), under §174-24 (C) (9) (b); §174-25 (E); and <br /> §174-17 of the Zoning Bylaws, on property located in an R-3 Zoning District, Map 90 Parcel 83 <br /> and Map 90 Parcel 97, Mashpee,MA subject to the following conditions: <br /> 1. Conditioned on the recommendations submitted by the Town Planner in a memo dated <br /> June 5, 2023 to the ZBA Secretary as part of this decision. <br /> 2. Conditioned upon the Engineering Review Reports provided by Pesce Engineering dated <br /> June 13, 2023 and June 26, 2023 as part of this decision. <br /> 3. Prior to the request of a building permit,the applicant shall issue a working capital account <br /> in the amount of$5,000. The check shall be issued to the Town of Mashpee to be utilized <br /> to pay for the initial peer review, and for future peer review inspections and signoffs if <br /> required. <br /> 4. Conditioned on all Town Department comments read into the record, and all public <br /> comments read into the record. <br /> 5 <br />
