MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO SPECIAL PERMITS) <br /> (SP-83-3-008, SP-00-167, SP-02-59, SP-2020-06) <br /> Owner, 21 Frog Pond Close, LLC <br /> 21 Frog Pond Close(Map 90 Parcel 83) <br /> 352 Mashpee Neck Road (Map 90 Parcel 97) <br /> Mashpee, MA 02649 <br /> MOD-2023-32 <br /> Mr. Bonvie mentioned that the Board can condition that a trained professional provides <br /> inspections, and monthly inspections. The Board would prefer that this O&M report specifically <br /> state the revised language; that an assigned trained professional, either a qualified engineer, or a <br /> designee provide the inspections and maintenance of the site. <br /> Mr. Reidy stated for the record that he reviewed the conditions and recommendations provided <br /> by the various departments at the previous meeting, and also suggested that the Board condition <br /> subject to approval by the Conservation Commission. <br /> Attorney Kirrane stated for the record that his client understands these conditions, and that if <br /> there are any changes to the plans will require the applicant to return to the Zoning Board. <br /> Mr. Bonvie wanted confirmation that if there is a change to a plan by the Conservation <br /> Commission,the applicant will be required to return to the Board with a revised plan. <br /> Mr. Dibb stated for the record that Sheets 1 and 2 of the plan submitted by Crawford Land <br /> Management (CLM) in the document are the mitigation and landscape plans. stated that the <br /> Board would also need to determine if these changes to a plan or plans are considered a minor or <br /> major modification. <br /> Attorney Kirrane mentioned for the record that he acknowledges that all the various departments <br /> were well reviewed and provided their specific recommendations. <br /> Mr. Reidy read a comment into the record dated June 26, 2023 from Dan Kent, Assistant <br /> Conservation Agent. He also read the comments from Evan Lehrer, Town Planner dated June 5, <br /> 2023 regarding that the office use of the accessory dwelling is an allowed use. He read an email <br /> dated June 9, 2023 from Harbormaster into the record; "no issues". <br /> Chairman Furbush read an email letter into the record dated May 23, 2023 from Evan Lehrer, <br /> Town Planner. He also summarized for the record, an additional email from the Town Planner <br /> dated June 14, 2023. <br /> Attorney Kirrane stated for the record that both properties are under one ownership, and he <br /> provided the Board with a copy of the deed that is documented under ownership as "21 Frog <br /> Pond Close, LLC." <br /> The Board received several letters from residents and were read into the record. There were <br /> several residents at the hearings. <br /> 4 <br />
